Email, mobile number and street address are required; notices bind when sent to the last address

The Bank requires an email address, mobile telephone number and physical street address; a P.O. Box is not accepted as the address. The depositor must promptly notify Affirm of changes to contact information or name, and the Bank may request additional verification. A notice mailed or emailed is binding when sent to the last postal or electronic address in the Bank's records. The Bank is not required to close it if there are pending transactions, the account is overdrawn, the account is linked to a Debit Card Account with unpaid card obligations, or the account is subject to investigation, review or legal process such as garnishment, attachment, execution or levy. In those cases the Bank restricts future withdrawals other than under legal process until pending transactions are paid or returned, the balance is no longer negative and any legal restriction is released. Account & Service Control · Procedure

Death or court-declared incompetence must be reported; the Bank may freeze funds until documents establish entitlement

An agent, attorney, personal representative, executor, administrator or successor must tell the Bank immediately if the depositor dies or is declared incompetent by a court. The Bank may act as if the depositor is alive and competent until it receives notice. After notice it may freeze the balance, refuse transactions and reverse or return deposits. It need not release funds until it receives documents it reasonably requests to verify death or incompetence and who is entitled to the funds. If the depositor dies while residing outside the United States, the Bank may require a U.S. court-appointed personal representative. The estate must repay any tax liability the Bank incurs from paying the balance to the estate. A transaction authorized before death may be paid if presented later. A debt owed at death allows setoff or security-interest rights against the balance. Disbursement may await documents verifying the death or incompetence and the new person's authority.

J.5. Death or Incompetence of Account Owner. Your agent, attorney, personal representative, executor, administrator, or successor must tell us immediately if you die or are declared incompetent by a court. We may act as if you are alive and competent until we receive notice otherwise. After we receive notice of your death or incompetence, we may freeze your balance, refuse to accept transactions, and reverse or return deposits. We are also not required to release your funds until we receive any documents we reasonably request to verify your death or incompetence, as well as who is entitled to the funds. If you die while residing outside the United States, we may require a personal representative to be appointed by a court in a United States jurisdiction. If we have any tax liability because of paying your balance to your estate, the estate will be responsible for repaying us the amount of that tax. If you authorize any transaction, but it's not presented for payment until after you die or are declared incompetent, we are authorized to pay the transaction. If you owe us a debt at the time of your death, we are authorized to exercise our right of setoff (our right to apply funds in one Account to the debt associated with another account) or security interest rights against the funds credited to your balance after your death. We are also not required to disburse funds until we receive any documents we reasonably request to verify your death or incompetence and to establish a new person's authority to act in transacting on or closing your Savings Account.

Qualifications & exceptions

  • The Bank may act as if the depositor is alive and competent until notice.
  • Freezing, refusing transactions and reversing deposits are permitted after notice.
  • Release of funds may await reasonably requested documents.

Inactive or abandoned accounts follow state law; activity can prevent that status

State laws determine when an account is inactive or abandoned and when the Bank must send funds to the state. The account may be considered inactive or abandoned unless, within a period set by law, the depositor contacted the Bank or conducted activity related to the account, such as depositing or withdrawing funds; certain preauthorized and automatic deposits or withdrawals may be excluded. The list of activity examples continues after this packet.

Unlocated inactive accounts are delivered to the state as abandoned property

After a period set by the law of the depositor's state of residence, if the Bank cannot locate the depositor it must deliver the savings account to the state as abandoned property. If the account is or has been inactive, the Bank may in its discretion refuse withdrawal requests until it verifies that the depositor authorized the request.
