If liability limits are held not to apply, they apply as far as law allows, with liability capped at $100

If a court or arbitration panel determines that the limitations of liability or remedies in the Terms do not apply to You or are unenforceable for any reason, You expressly agree that the provisions will be construed to apply to the maximum extent permitted by law, and that under no circumstances will the total, aggregate liability of Fidelity and all Third Party Content Providers for any cause relating to this agreement, the Fidelity Websites, or any Fidelity or Third Party Content on them exceed $100.

IF THE LIMITATIONS OF LIABILITIES OR REMEDIES IN THESE TERMS ARE DETERMINED BY A COURT OR ARBITRATION PANEL TO NOT APPLY TO YOU OR TO BE UNENFORCEABLE FOR ANY REASON, THEN YOU EXPRESSLY AGREE THAT THESE PROVISIONS WILL BE CONSTRUED TO APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW AND THAT UNDER NO CIRCUMSTANCES WILL THE TOTAL, AGGREGATE LIABILITY OF FIDELITY AND ALL THIRD PARTY CONTENT PROVIDERS FOR ANY CAUSE WHATSOEVER RELATING TO THIS AGREEMENT, THE FIDELITY WEBSITES, OR ANY FIDELITY OR THIRD PARTY CONTENT ON THE FIDELITY WEBSITES, EXCEED $100.
Nothing in these Terms alters or supersedes any rights or protections that might be provided to You under Regulation E.

Qualifications & exceptions

  • The $100 cap is stated as part of the consequence of a court or arbitration panel determining that the limitations do not apply or are unenforceable.
  • The Terms state that nothing in them alters or supersedes any rights or protections that might be provided to You under Regulation E (stated in the Password Security section).

Not stated here

  • The passage does not say whether the $100 figure is meant to apply in any circumstance other than that determination.
  • The passage mentions an arbitration panel, but these Terms' own dispute clause points to courts; other agreements are not part of this source.
  • Regulation E is not supplied in this source, so how the cap would interact with those rights or protections is not described here.
