The Terms make the Privacy Policy part of the contract and say acceptance confirms review and consent to that policy and compliance with incorporated terms. They point to it for information management, export and deletion. That linked policy is not supplied here, so these Terms alone do not establish its detailed data rules. Users also agree to keep use within the purposes described by these Terms.
Besides these terms, we also publish a flo.health/privacy-policy (“Privacy Policy”). We encourage you to read it to better understand how you can update, manage, export, and delete your information.

The introduction highlights binding individual arbitration and a class-action waiver in Section 25, to the extent law permits. Section 25 preserves small-claims and certain other court routes, provides local laws and courts for EU, UK, Swiss, Norwegian and Icelandic residents, and allows a written arbitration opt-out postmarked within 30 days after first acceptance. The opt-out must include your name, account email and a statement declining arbitration, sent to Flo Health UK Limited, 27 Old Gloucester Street, London, England, WC1N 3AX.
1.2. PLEASE CAREFULLY READ THE BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER IN SECTION 25. IT AFFECTS HOW DISPUTES ARE RESOLVED BETWEEN YOU AND FLO AND INFORMS YOU OF YOUR OPT-OUT RIGHTS.
a. ARBITRATION: To the fullest extent permitted under applicable law and in the interest of resolving disputes between you and the Company in an expedient and cost-effective manner, you and the Company agree that any dispute, claim or controversy arising out of or relating to this Agreement (collectively, “Disputes”) shall be settled by binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association (the “AAA Rules”) then in effect, except as modified in this Agreement. The AAA Rules and filing forms are available online at www.adr.org.
b. If you are a resident of any European Union country or the United Kingdom, Switzerland, Norway or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.
c. SMALL CLAIMS COURT: As an alternative to arbitration, you and the Company each retain the right to bring any Dispute in any small claims court with jurisdiction over the Dispute.
i. ARBITRATION OPT-OUT: You can decline this agreement to arbitrate by sending a written communication to Flo Health UK Limited, 27 Old Gloucester Street, London, England, WC1N 3AX, postmarked within 30 days after first accepting this Agreement. Your written communication must provide your name and the email address associated with your Account and must state that you decline this arbitration agreement.
k. COURT PROCEEDINGS: Consistent with the AAA Rules and applicable law, nothing in this Section 25 will be deemed to waive, preclude, or otherwise limit the right of either party to (i) bring an individual action in small claims court, where such court has jurisdiction over the Dispute; (ii) seek injunctive or interim relief from a court with jurisdiction to provide such relief; (iii) seek aid in support of the arbitration under applicable law; or (iv) seek to enforce or vacate (in whole or in part) the award under applicable law. If applicable law does not allow the arbitration of Disputes under this Agreement, then either you or the Company may instead commence dispute resolution proceedings in any court that has jurisdiction over the Dispute, and where venue is proper, subject to the terms of Section 25(l)(i-iii) below and all terms outlined in Sections 1-21 and 23-25.
(ii) NO CLASS OR REPRESENTATIVE ACTIONS OR PROCEEDINGS: TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, YOU AND THE COMPANY AGREE THAT EACH MAY BRING DISPUTES AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Flo and the listed related parties disclaim express and implied warranties, including title, non-infringement, merchantability and fitness, except where law requires them. They do not promise security, continuous availability, corrected defects, virus-free software, results meeting your needs or accurate, reliable, complete third-party content, including Secret Chats. Some jurisdictions do not permit these warranty limits, so some or all may not apply.
16.2. THE APP IS PROVIDED “AS IS”, “AS AVAILABLE” AND IS PROVIDED WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED, SAVE TO THE EXTENT REQUIRED BY LAW. Legal Rights & Agreement Rules · Restriction or exception
The Terms seek to exclude indirect, special, incidental, consequential, exemplary and punitive damages connected to App use or misuse, including lost use, profits and data. They cap Flo’s total liability at what you paid Flo for App use, or $100 if you had no payment obligations. They also seek to exclude personal-injury and death liability for listed parties. These exclusions and limits do not apply where unlawful; an excessive exclusion is reduced to the maximum the applicable law permits. The $100 figure is not stated as a minimum for paying users.
17.1. IN NO EVENT SHALL THE COMPANY OR ANY OF ITS OFFICERS, DIRECTORS, AGENTS, AFFILIATES, EMPLOYEES, REPRESENTATIVES, SUPPLIERS, PARTNERS, ADVERTISERS, OR DATA PROVIDERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS, OR LOSS OF DATA) WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE), EQUITY OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR MISUSE OF THIS APP. Flo may link to third-party websites, apps and services but says it does not control them, endorse linked material or take responsibility for their privacy practices, information or offerings. Use is at your risk: assess suitability, protect your information and follow applicable third-party agreements. The Agreement still preserves liability that law does not allow Flo to exclude.
19.1. The App may give you access to links to third-party websites, apps, or other products or services (“Third Party Services”). The Company does not control Third Party Services in any manner and, accordingly, the Company is not responsible for the privacy practices of such Third Party Services and does not assume any liability associated with such Third Party Services. You need to take appropriate steps to determine whether accessing a Third Party Service is appropriate, including protecting your personal information and privacy in using any such Third Party Services and complying with relevant agreements.

Legal Rights & Agreement Rules · Context
For Section 20, a Clinician is a licensed healthcare provider employed or contracted by the Telehealth Provider. Telehealth Services are medical services delivered synchronously or asynchronously in the United States. White-label providers deliver clinical care through a Flo-branded interface; referral providers contract and transact directly with users.
20.2. Definitions. For the purposes of this Section 20, the following definitions apply:
“Clinician(s)” means a licensed health care provider that is employed by or contracted with the Telehealth Provider to render the Telehealth Services.
“Telehealth Services” means the medical services rendered by a Clinician using synchronous and asynchronous telehealth technology in the United States of America.
“White-label Telehealth Provider“ means a third-party licensed healthcare provider that delivers clinical telehealth services through a Flo-branded interface.
“Referral Telehealth Provider” means a third-party licensed healthcare provider to whom Flo may direct users for telehealth services, where the user contracts and transacts directly with that provider.
Legal Rights & Agreement Rules · Restriction or exception
The App redirects you to the provider’s platform; available services and Flo’s facilitating role vary by provider. The provider and clinicians alone deliver care, are responsible for their acts or omissions and decide eligibility. Flo disclaims accountability for those service decisions, provides no clinical advice and forms no doctor-patient relationship with you. It does not screen, edit, endorse or guarantee your communications with the provider.
20.4. Telehealth Providers and the Telehealth Services. The Telehealth Services are offered by third-party Telehealth Providers who contract with Flo to facilitate your access to Telehealth Services rendered by a Telehealth Provider’s Clinicians. If you choose to use Telehealth Services, you will be redirected from the App to the Telehealth Provider’s platform. The specific services available to you, and the extent of Flo's role in facilitating them, may vary depending on which Telehealth Provider you use; in each case, the Telehealth Services themselves are rendered directly to you by that Telehealth Provider's Clinicians.
All Telehealth Services are provided solely by the Telehealth Provider and its Clinicians, and not by Flo. The Telehealth Provider and its Clinicians are responsible for any acts or omissions in providing the Telehealth Services to you. The Telehealth Provider is solely responsible for determining your eligibility to receive Telehealth Services and may, in its sole discretion, determine that you are not a suitable candidate. Flo shall not be accountable for any service or non-service decisions made by the Telehealth Provider or its Clinicians.
20.5 No Medical Advice. FLO DOES NOT PROVIDE MEDICAL CARE, TELEHEALTH SERVICES, OR CLINICAL ADVICE. Flo’s role is limited to providing the Telehealth Feature, to coordinate access to the Telehealth Provider for the purpose of facilitating the Telehealth Services. No doctor-patient relationship is formed between you and Flo through the App. Any Telehealth Services between you and a Clinician are separate and distinct from the services rendered by Flo. Flo cannot and does not edit, modify, filter, screen, endorse, or guarantee any contents or communications shared between you and the Telehealth Provider. Any access to your medical information developed through your receipt of Telehealth Services will be made available to Flo only pursuant to your express consent, which consent will specify the scope of information shared and your right to revoke it.
20.7 Fees, payment, cancellation and refund for Telehealth Services. If you choose to use the Telehealth Services, those services are offered and delivered independently by the Telehealth Provider.
Legal Rights & Agreement Rules · Restriction or exception
Telehealth uses the provider’s separate terms and policies, which are not supplied here. Flo does not endorse or recommend providers, clinicians, tests, medicines, products, treatments or procedures, or guarantee service quality, suitability, legality or availability. You remain free to choose another healthcare provider.
20.6. Telehealth Provider Terms; No Endorsement. Your use of Telehealth Services is subject to the terms, conditions, and policies of the Telehealth Provider, which are separate and independent from these Terms of Use and Privacy Policy. Flo does not endorse, or recommend any Telehealth Provider or Clinician, and does not guarantee the quality, suitability, legality, or availability of any Telehealth Provider or Clinician or any services offered by them. Flo does not endorse any tests, medications, products, treatments, or procedures. You remain free to use any healthcare provider or service of your choice.
Legal Rights & Agreement Rules · Restriction or exception
To the extent permitted by law, agreement-related disputes generally go to binding individual arbitration under the AAA Consumer Rules as modified by these Terms. Either side may instead use a competent small-claims court; certain other court remedies remain available. EU, UK, Swiss, Norwegian and Icelandic residents are given the laws and courts of their usual residence. A written opt-out postmarked within 30 days of first acceptance can decline arbitration. Separate lawful limits on class and consolidated proceedings remain stated for all dispute forums.
PLEASE READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE CERTAIN DISPUTES AND CLAIMS WITH US AND LIMITS THE MANNER IN WHICH YOU MAY SEEK RELIEF FROM US.
If applicable law does not allow the arbitration of Disputes under this Agreement, then either you or the Company may instead commence dispute resolution proceedings in any court that has jurisdiction over the Dispute, and where venue is proper, subject to the terms of Section 25(l)(i-iii) below and all terms outlined in Sections 1-21 and 23-25.
m. ADDITIONAL PROVISIONS APPLICABLE TO ALL DISPUTE RESOLUTION: The following additional provisions are applicable to the resolution of all Disputes, to the fullest extent allowed by applicable law, regardless of whether brought in arbitration, court, or any other type of formal dispute resolution proceeding:
(iii) No Consolidation: You and the Company acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate in a consolidated proceeding.
Legal Rights & Agreement Rules · Procedure
Where arbitration applies, US residents may choose their home state or New Castle County, Delaware. For other residents the arbitrator selects location under AAA factors, subject to the special resident-country court provision for the EU, UK, Switzerland, Norway and Iceland. You may choose phone or video hearings. Documents-only resolution needs both parties’ written agreement delivered to the arbitrator. Procedural law follows the place of arbitration and AAA Rules, and the Federal Arbitration Act governs US arbitration and related court proceedings. The external rules and law are not supplied.
d. PLACE OF ARBITRATION/ CONDUCT OF HEARING(S): If you reside in the United States, then the place of the arbitration shall be, at your option, either (a) the state where you reside, or (b) New Castle County, Delaware. If you reside outside the United States, then the Arbitrator shall determine the place of arbitration based on the factors stated in the AAA Rules. Regardless of the place of arbitration, the Company agrees that any required arbitration hearing(s) may be conducted, at your option, by phone or video conference rather than in person. The arbitration may also be decided solely on the submission of documents to the Arbitrator, if you and the Company both so agree (which agreement must be made in writing and provided to the Arbitrator). The procedural law applicable to the conduct of the arbitration shall be the law of the place of arbitration and the AAA Rules. The Federal Arbitration Act shall govern all arbitration proceedings (and any related and/or resulting court proceedings) in the United States.
b. If you are a resident of any European Union country or the United Kingdom, Switzerland, Norway or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.
Legal Rights & Agreement Rules · Procedure
Both parties must give written notice at least 30 days before starting arbitration and try in good faith to resolve the dispute. Your notice goes to Flo Health UK Limited, 27 Old Gloucester Street, London, England, WC1N 3AX; Flo uses your account email. Include the claimant’s name, preferred contact details, a brief dispute description and requested relief. If unresolved after 30 days, either party may file an AAA demand and send the other party a copy under AAA Rules.
e. NOTICE OF DISPUTE/ INFORMAL SETTLEMENT EFFORTS: At least 30 days prior to initiating an arbitration, you and the Company each agree to notify the other party of the dispute in writing (the “Notice of Dispute”) and attempt in good faith to negotiate an informal resolution. You must send your Notice of Dispute to: Flo Health UK Limited, 27 Old Gloucester Street, London, England, WC1N 3AX. The Company will send any Notice of Dispute to the email address associated with your Account. A Notice of Dispute must include: the name of the person bringing the Dispute and that person’s preferred contact information, a brief description of the dispute, and the relief sought. If you and the Company are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written Demand for Arbitration (see www.adr.org) with the American Arbitration Association and providing a copy to the other party as specified in the AAA Rules.
Legal Rights & Agreement Rules · Restriction or exception
An arbitration award is final, binding and enforceable, subject to the review available under applicable enforcement and annulment law. A court with proper jurisdiction may enter judgment. Relief must be allowed by law or AAA Rules; declarations or injunctions may be awarded only individually to the extent warranted by the claimant’s own claim.
g. FORM, EFFECT, AND SCOPE OF ARBITRATION AWARD: The Arbitrator’s judgment and award shall be final, binding and enforceable, subject to review only in accordance with applicable law governing the enforcement and annulment of arbitration awards. Judgment on the Award may be entered in any court with proper jurisdiction, pursuant to applicable law. The Arbitrator may award any relief allowed by law or the AAA Rules, but declaratory or injunctive relief may be awarded only on an individual basis to the extent necessary to provide relief warranted by the claimant’s individual claim.

To decline arbitration, send written notice to Flo Health UK Limited, 27 Old Gloucester Street, London, England, WC1N 3AX, postmarked within 30 days after first accepting the Agreement. Include your name, account email and a statement declining the arbitration agreement. This clause addresses arbitration, not every other dispute restriction.
i. ARBITRATION OPT-OUT: You can decline this agreement to arbitrate by sending a written communication to Flo Health UK Limited, 27 Old Gloucester Street, London, England, WC1N 3AX, postmarked within 30 days after first accepting this Agreement. A clause placed in the arbitration section allows written rejection of a change, postmarked within 30 days of its effective date, to Flo Health UK Limited, 27 Old Gloucester Street, London, England, WC1N 3AX. It says earlier consent to arbitration remains in effect. However, its trigger literally refers to changes to “this Section 22,” while the arbitration heading is Section 25 and Section 22 is Enforcement rights. The supplied text does not establish that the reference should be rewritten; the card does not promise this procedure covers every arbitration amendment.
j. CHANGES: If the Company changes this Section 22 after the date you last accepted this Agreement (or accepted any subsequent changes to this Agreement), you may reject that change by sending us written notice to Flo Health UK Limited, 27 Old Gloucester Street, London, England, WC1N 3AX, postmarked within 30 days of the date on which the change is effective. Rejecting a change, however, does not revoke or alter your prior consent to any earlier agreement to arbitrate any Dispute between you and the Company (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable as to any Dispute between you and the Company.

Subject to AAA Rules and applicable law, either party may use a competent small-claims court, seek injunctive or interim relief, obtain support for arbitration, or enforce or challenge an award. If law disallows arbitration, the Terms permit court proceedings with jurisdiction and proper venue, subject to stated other terms. The fallback literally cites “Section 25(l)(i-iii),” but the three additional restrictions appear after a paragraph labeled “m.” No corrected numbering is assumed. Those provisions independently state that they apply across dispute forums, subject to law. The separate resident-country court exception and 30-day arbitration opt-out also remain.

If applicable law does not allow the arbitration of Disputes under this Agreement, then either you or the Company may instead commence dispute resolution proceedings in any court that has jurisdiction over the Dispute, and where venue is proper, subject to the terms of Section 25(l)(i-iii) below and all terms outlined in Sections 1-21 and 23-25.
(i) Time Limitation: Any Dispute shall be time-barred unless the party asserting the Dispute commences formal dispute resolution proceedings within one (1) year after the basis for such Dispute became known or should have become known to the party asserting the Dispute, provided, however, that the one-year period shall be deemed suspended during any informal settlement discussions following the receipt of a Notice of Dispute by any party pursuant to Section 25(e) above.
(iii) No Consolidation: You and the Company acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate in a consolidated proceeding.
b. If you are a resident of any European Union country or the United Kingdom, Switzerland, Norway or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.
Legal Rights & Agreement Rules · Restriction or exception
The Terms say both you and Flo waive jury-trial rights to the fullest extent allowed by applicable law. Non-waivable local rights remain protected.
I. IN ADDITION, TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, YOU AND THE COMPANY UNCONDITIONALLY WAIVE ANY RESPECTIVE RIGHTS TO A JURY TRIAL.
NOTE: Depending on where you live, you may have rights under applicable local laws that cannot be waived. Nothing in this Agreement limits any such rights under those laws.
Legal Rights & Agreement Rules · Restriction or exception
To the fullest extent law permits, formal dispute proceedings must begin within one year after the basis became known or should have become known. The period is suspended during informal settlement discussions following receipt of the Section 25(e) Notice of Dispute. That notice procedure requires written notice and a good-faith attempt to settle at least 30 days before arbitration. This deadline is stated for arbitration, court and other formal proceedings, not just arbitration.
(i) Time Limitation: Any Dispute shall be time-barred unless the party asserting the Dispute commences formal dispute resolution proceedings within one (1) year after the basis for such Dispute became known or should have become known to the party asserting the Dispute, provided, however, that the one-year period shall be deemed suspended during any informal settlement discussions following the receipt of a Notice of Dispute by any party pursuant to Section 25(e) above.
To the fullest extent permitted by applicable law, each side may bring disputes only individually, not as a class or representative plaintiff or member, and waives participation in consolidated proceedings. The section states these restrictions apply across arbitration, courts and other formal forums. Non-waivable local rights are preserved.
(iii) No Consolidation: You and the Company acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate in a consolidated proceeding.
NOTE: Depending on where you live, you may have rights under applicable local laws that cannot be waived. Nothing in this Agreement limits any such rights under those laws.
Legal Rights & Agreement Rules · Context
The general governing-law clause selects Delaware law without its conflict-of-law rules, only as far as applicable law permits. Section 25 separately gives EU, UK, Swiss, Norwegian and Icelandic residents the laws and courts of their usual residence. Non-waivable local rights remain intact.
26.1. To the fullest extent permitted pursuant to applicable law, this Agreement shall be governed by the laws of the State of Delaware, U.S.A. (to the exclusion of its conflict of law rules).
b. If you are a resident of any European Union country or the United Kingdom, Switzerland, Norway or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.

Flo may change the Agreement when it thinks necessary. For material changes, it will post the update and make reasonable efforts to notify users. Changes become binding 30 days after posting; continued service use after the effective date indicates acceptance, and users who disagree should stop using the services. Contact support with questions, but emailing alone does not reject the change. A separate clause in the arbitration section describes written rejection while retaining earlier arbitration consent, though its literal “Section 22” reference is inconsistent; this card does not resolve that drafting ambiguity.
28.1. We may modify this Agreement from time to time if we think it is necessary (e.g. for legal reasons or to reflect changes in the App, website). If we materially change the Agreement, we will make the update Agreement available online and make reasonable efforts to tell you about it (e.g. by sending you a notice). Any translation from the English version is provided for your convenience only. In the event of any difference in meaning or interpretation between the English language version of these Terms, and any translation, the English language version will prevail. The original English text shall be the sole legally binding version.
28.2. Once we change the Agreement, it will become legally binding on you thirty (30) days after we post it online. During that period, you are welcome to contact us at support@flo.health if you have specific questions about the changes. If you do not agree to those changes (regardless of whether you email us), then unfortunately we need to ask you to cease using Flo App, and access the website. We are sorry we have to say that, but we hope you will appreciate that for Flo to work properly we need to have everyone using it under the same rules instead of different people having different rules. That is why we encourage you to get in contact if you have queries or concerns.
28.3. If you don’t agree to the new terms, you should stop using our services. Your continued use of the services after the effective date of an updated version of the Agreement will indicate your acceptance of the Agreement as modified.
Legal Rights & Agreement Rules · Restriction or exception

The agreement benefits the parties and Flo’s successors. Flo reserves the right to assign rights and obligations to affiliates or any “Flo Entity.” The supplied clause does not define that latter label or give users a matching assignment right.
28.4. Successors and Assigns. This agreement ensures the benefit of the parties, including any of our successors in interest. We have the right to assign our rights and obligations under this agreement to any affiliates or to any Flo Entity.
Legal Rights & Agreement Rules · Procedure
If a competent court, tribunal or arbitrator finds a provision or part unenforceable, the Terms say it should be enforced as far as permissible to effect the Agreement’s intent, with the rest continuing. They also say a printed Agreement is admissible in arbitral, judicial or administrative proceedings. This describes the contract’s rule, not a prediction of a court’s decision.
28.5. Severability. If for any reason an arbitrator, an arbitral or other tribunal, or a court of competent jurisdiction finds any provision of this Agreement, or any portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to affect the intent of this Agreement, and the remainder of this Agreement shall continue in full force and effect. A printed version of this Agreement shall be admissible in arbitral, judicial or administrative proceedings.
Legal Rights & Agreement Rules · Restriction or exception
A Flo waiver is not a continuing waiver or a waiver of other terms. Flo’s failure to assert a right or provision does not itself waive it.
28.6. No waiver by the Company of any term or condition set forth in this Agreement shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under this Agreement shall not constitute a waiver of such right or provision.
Legal Rights & Agreement Rules · Restriction or exception
Terms that by their nature should survive continue after termination, expressly including dispute resolution and arbitration, ownership, warranty disclaimers and liability limits. This does not remove their stated exceptions or legal limits.
28.7. Upon termination of this Agreement, all provisions of this Agreement that by their nature, should survive termination, shall survive termination, including, without limitation, the provisions on dispute resolution and arbitration, all ownership provisions, warranty disclaimers, and limitations of liability.

Flo says it carefully examines materials made available to ages 13–17 to avoid inappropriate or harmful content, neither intends nor knowingly publishes sexually explicit or legally harmful content for minors, and makes reasonable efforts toward factual, scientifically accurate material.
