App operators receive permission to handle information for operation

You grant Flo and others involved in operating the App the right to transmit, monitor, retrieve, store and use your information in connection with App operation. This stated purpose does not establish unlimited use for unrelated purposes. This general operational permission does not remove the separate express-consent requirement for Flo access to medical information developed through telehealth care.

15.2. You grant the Company and all other persons or entities involved in the operation of the App the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the App. You further acknowledge and agree that the App and account are designed and intended for personal use on an individual basis and you should not share your account and/or password details with another individual. The Company cannot and does not assume any responsibility or liability for any information you submit, or your or third parties’ use or misuse of information transmitted or received arising from the using the App, and shall not be responsible for any losses arising out of the unauthorised use of your account or information resulting from you not following these rules.
20.5 No Medical Advice. FLO DOES NOT PROVIDE MEDICAL CARE, TELEHEALTH SERVICES, OR CLINICAL ADVICE. Flo’s role is limited to providing the Telehealth Feature, to coordinate access to the Telehealth Provider for the purpose of facilitating the Telehealth Services. No doctor-patient relationship is formed between you and Flo through the App. Any Telehealth Services between you and a Clinician are separate and distinct from the services rendered by Flo. Flo cannot and does not edit, modify, filter, screen, endorse, or guarantee any contents or communications shared between you and the Telehealth Provider. Any access to your medical information developed through your receipt of Telehealth Services will be made available to Flo only pursuant to your express consent, which consent will specify the scope of information shared and your right to revoke it.

Use & Processing · Restriction or exception

Clinical records use the provider’s privacy rules unless you authorize Flo

For medical telehealth services delivered in the US, clinical and medical records supplied to or received from the provider use its privacy notice and policy. A separate voluntary HIPAA authorization to Flo brings only the covered Private Information under Flo’s policy to the extent authorized; it is optional and not required for referral or care. Flo disclaims responsibility for providers’ privacy and security practices. These external policies and the authorization form are not supplied here.

20.10 Privacy and Data Protection. Once you initiate a Telehealth Service, the collection, use, and disclosure of the clinical and medical records you provide to or receive from the Telehealth Provider are governed exclusively by that Telehealth Provider's own Notice of Privacy Practices and privacy policy, and not by Flo's Privacy Policy, except if you separately and voluntarily sign a HIPAA authorization directly with Flo. In this instance, the Private Information covered by that authorization is instead governed by Flo's Privacy Policy to the extent of that authorization. This authorization is optional and is not a condition of your ability to be referred to, or to receive Telehealth Services. Flo is not responsible for the privacy or data security practices of any Telehealth Provider.
“Private Information” means your personal data as described in our Privacy Policy (flo.health/privacy-policy), and may include protected health information (“PHI”) as defined under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), and other private or personal information as defined in applicable privacy laws, provided to Flo solely through your use of the Telehealth Feature.
“Telehealth Services” means the medical services rendered by a Clinician using synchronous and asynchronous telehealth technology in the United States of America.
