Telehealth requires age 18, eligible US location and accurate information

To use the feature, you must be at least 18, have legal authority, provide accurate, true, current and complete Private Information, and not need emergency or immediate care. Access is limited to certain US states, which this clause does not name. You direct Flo to transmit your Private Information to providers and clinicians solely to facilitate receipt of telehealth services. The provider separately decides clinical suitability and may decline service.

20.3. Eligibility Requirements. To use the Telehealth Feature, you acknowledge and agree that: (a) you are eighteen (18) years of age or older and have the legal right and authority to access the Telehealth Feature; (b) all Private Information you provide through the Telehealth Feature is accurate, true, current, and complete; (c) you direct and instruct Flo to transmit your Private Information to the Telehealth Provider and its Clinicians solely for the purpose of facilitating your receipt of Telehealth Services, and you acknowledge that this transmission occurs at your direction; (d) the Telehealth Feature is only available for use in the limited states in the United States of America; and (e) you are not currently experiencing a medical emergency and are not in need of immediate medical attention.

The Telehealth Provider is solely responsible for determining your eligibility to receive Telehealth Services and may, in its sole discretion, determine that you are not a suitable candidate. Flo shall not be accountable for any service or non-service decisions made by the Telehealth Provider or its Clinicians.

Flo access to clinical information requires express consent

Flo says access to medical information developed through telehealth care requires express consent specifying scope and revocation rights. Clinical records given to or received from the provider are governed by that provider’s privacy notice and policy, except that a separate voluntary HIPAA authorization to Flo brings covered information under Flo’s policy to that extent. Authorization is optional and not required for referral or treatment; those separate policies and authorization text are not supplied here.

Supporting quotations

20.5 No Medical Advice. FLO DOES NOT PROVIDE MEDICAL CARE, TELEHEALTH SERVICES, OR CLINICAL ADVICE. Flo’s role is limited to providing the Telehealth Feature, to coordinate access to the Telehealth Provider for the purpose of facilitating the Telehealth Services. No doctor-patient relationship is formed between you and Flo through the App. Any Telehealth Services between you and a Clinician are separate and distinct from the services rendered by Flo. Flo cannot and does not edit, modify, filter, screen, endorse, or guarantee any contents or communications shared between you and the Telehealth Provider. Any access to your medical information developed through your receipt of Telehealth Services will be made available to Flo only pursuant to your express consent, which consent will specify the scope of information shared and your right to revoke it.
20.10 Privacy and Data Protection. Once you initiate a Telehealth Service, the collection, use, and disclosure of the clinical and medical records you provide to or receive from the Telehealth Provider are governed exclusively by that Telehealth Provider's own Notice of Privacy Practices and privacy policy, and not by Flo's Privacy Policy, except if you separately and voluntarily sign a HIPAA authorization directly with Flo. In this instance, the Private Information covered by that authorization is instead governed by Flo's Privacy Policy to the extent of that authorization. This authorization is optional and is not a condition of your ability to be referred to, or to receive Telehealth Services. Flo is not responsible for the privacy or data security practices of any Telehealth Provider.

Referral telehealth has independent billing but may involve consented data sharing

For referral-only providers such as Allara, you contract and transact directly with the provider. Flo collects no payment, and the provider’s terms govern fees, subscriptions and refunds; billing inquiries go there. Flo disclaims responsibility for its fees, billing, quality and availability. Separately, Flo may share limited Private Information to facilitate referral based on your consent. Private Information here concerns data provided to Flo solely through the Telehealth Feature, potentially including health information; payment independence does not mean no data sharing.

Supporting quotations

20.8 Referral-Only Telehealth Providers. Certain Telehealth Providers accessible through the Flo App are made available solely on a referral or marketing basis, and Flo collects no payment in connection with those services, e.g. Allara (“Referral Telehealth Provider”). For Referral Telehealth Providers: (a) Flo directs you to the Referral Telehealth Provider’s platform, and as described in (e) below, may share limited Private Information with the Referral Telehealth Provider to facilitate the referral; (b) all fees, billing, subscriptions, and refunds are governed exclusively by the Referral Telehealth Provider’s own terms and policies; (c) Flo has no liability for the Referral Telehealth Provider’s fees, billing practices, service quality, or availability; (d) all billing and refund inquiries must be directed to the Referral Telehealth Provider; and (e) notwithstanding that Flo collects no payment in connection with Referral Telehealth Provider services, Flo may, on the basis of your consent, share Private Information with Telehealth Providers. This is separate from and does not affect, the payment and billing independence described in paragraphs (b) through (d) above.
“Private Information” means your personal data as described in our Privacy Policy (flo.health/privacy-policy), and may include protected health information (“PHI”) as defined under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), and other private or personal information as defined in applicable privacy laws, provided to Flo solely through your use of the Telehealth Feature.
“Referral Telehealth Provider” means a third-party licensed healthcare provider to whom Flo may direct users for telehealth services, where the user contracts and transacts directly with that provider.
