b. You are allowed to create a single account for yourself, as an individual eighteen (18) years of age or older, in order to make use of our Services (an "Account"). You are also allowed to create an Account for each adult who has given you prior express written authorization to agree to these Terms and operate an Account on their behalf. You accept that, in order to create an Account, Function may require you to provide certain Personal Information and a login/password; this includes, without limitation furnishing a first and last name, date of birth, address, email address, race/ethnicity, height/weight, blood type, and information regarding your health history, your present health condition, and any symptoms. Such registration data and certain other information about you are governed by our Privacy Policy. You represent that you have provided and warrant that you will provide truthful, accurate, complete, up-to-date information at all times in connection with our Services; you further covenant that you will update any information that you furnish if, and as soon as, you learn that it is inaccurate, incomplete, and/or outdated; this applies, without limitation, to Personal Information. Only the Account holder, a person acting with the Account holder’s prior express written authorization acceptable to Function, or a person otherwise authorized under applicable law (e.g., a court-appointed guardian or an agent under a valid power of attorney) may manage an Account or request cancellation of a Subscription, closure or material modification of an Account, changes to payment or contact information, or a refund, Credit, or other financial adjustment. Authorization to manage billing or payment matters does not, by itself, authorize access to another User’s health or medical information, which remains subject to the User’s separate authorization and applicable law. Function may require identity verification and documentation reasonably sufficient to establish the requesting person’s authority before acting on a request and may decline or delay the request until that verification is completed. Merely paying for another person’s Subscription or Services, being related to that person, being identified as an emergency contact, or possessing that person’s login credentials does not by itself authorize a person to manage the Account or make requests on the Account holder’s behalf. Except as required by applicable law, Function will not act on a request made by anyone other than the Account holder or a verified authorized representative. Actions taken through the Account using the Account holder’s login credentials will be treated as authorized by the Account holder.
