Legal Rights & Agreement Rules · Restriction or exception
Notice up front: disputes go to arbitration and class and jury rights are limited
Near the top, the terms warn that they contain an arbitration agreement covering disputes between you and Starbucks. They say arbitration has less discovery and appellate review than court, and that the arbitration agreement and other provisions will remove your right to a jury trial to the extent the law allows. They also say these provisions substantially affect your rights, including preventing you from bringing, joining or participating in class or consolidated proceedings in arbitration and litigation. The operative rules are in the Dispute Resolution section further down.

Three Levels (Green, Gold, Reserve) set by Stars earned over 12 months
There are three Levels: Green, Gold and Reserve. Your Level depends on the Stars you accumulate over a 12-month period, and once you reach a Level you get that Level's benefits for the following 12 months, but you must keep earning the required Stars to keep it for the next year. Everyone starts at Green when they open an account. Earning at least 500 Stars within the 12 months after enrollment qualifies you for Gold. Earning at least 2,500 new Stars within 12 months after reaching Gold qualifies you for Reserve.
Supporting quotations
There are three (3) levels of Starbucks Rewards benefits: Green, Gold and Reserve levels (“Level(s)”).
Your Level is determined by the number of Stars that you accumulate in your account over a twelve (12) month period.
By opening an account, you will be automatically enrolled in Starbucks Rewards at the Green Level.
If you earn at least five hundred (500) Stars within the twelve (12) month period following your enrollment date, you will qualify for the Gold Level.
If you earn at least twenty-five hundred (2,500) new Stars during the 12-month period following the date you reached Gold Level, you will qualify for the Reserve Level.
Qualifications & exceptions
Gold needs at least 500 Stars within 12 months of enrollment
Reserve needs at least 2,500 new Stars within 12 months after reaching Gold
Starbucks can change these numbers (see the card on changes to Levels)
Not stated here
The terms do not say whether Stars earned before reaching Gold can count toward Reserve; they refer to "new" Stars after reaching Gold.
Account & Service Control · Restriction or exception
Keeping a Level needs the same Star totals each year; if you fall short your Level Star Balance resets to zero
If you do not earn at least 500 Stars in the first 12 months after enrolling, your Level Star Balance resets to zero and you stay at Green. To keep Gold, you must earn at least 500 new Stars in the 12 months after reaching Gold; otherwise you drop to Green and your Level Star Balance resets to zero. To keep Reserve you must earn at least 2,500 new Stars in the 12 months after reaching Gold; if you do not, you drop to Gold if you earned 500 to 2,499 Stars, or to Green if you earned 0 to 499, and the Level Star Balance resets to zero. In each case the terms say the reset does not affect the number of Stars available for Reward redemption.
Supporting quotations
your level Star balance, which is the Star balance amount that determines your Level (“Level Star Balance”), will automatically reset to zero (0) and you will remain at the Green Level
To maintain Gold Level benefits, you must earn at least five hundred (500) new Stars during the 12-month period following the date you reached the Gold Level.
you will be placed at the Green Level and your Level Star Balance will automatically reset to zero (0). (This will not affect your number of Stars available for Reward redemption.)
To maintain the Reserve Level benefits, you must earn at least twenty-five hundred (2,500) new Stars during the 12-month period following the date you reached Gold Level.
you will be placed at the Gold Level (if you earned between 500 and 2,499 Stars) or Green Level (if you earned between 0 and 499 Stars),and your Level Star Balance will automatically reset to zero (0).
Qualifications & exceptions
The reset applies to the Level Star Balance, not the Stars available for redemption

Qualifications & exceptions

Cross-references
contrast (model-proposed): Digital reload Bonus Stars: 10 Stars for a $30 reload, 25 Stars for $50, capped at 25 per transaction — contrast: Stars are not earned on Starbucks Card reloads or transfers except as noted, yet a digital reload benefit gives Bonus Stars for reloading a digital Card; the benefit excludes only the purchase of Starbucks Cards. The terms do not reconcile the two beyond the "except as noted" wording.

The Dispute Resolution section sends most disputes to individual arbitration and waives jury and class rights
The section opens by telling you to read it carefully because it affects your legal rights. It provides for resolving most disputes through individual arbitration instead of court trials and class actions. The terms describe arbitration as more informal than a lawsuit, using a neutral arbitrator rather than a judge or jury, with more limited discovery, and as final and binding with only very limited court review. The section also contains a jury trial waiver and a waiver of the right to proceed in a class, collective, consolidated, private attorney general or representative action, in arbitration or litigation, to the fullest extent the law allows.

Binding arbitration covers almost any claim about the terms, the program or your relationship with Starbucks
Any dispute or claim arising out of or relating to these terms, your access to or participation in Starbucks Rewards, or your relationship with Starbucks or any past, present or future subsidiary, parent or affiliate will be resolved through binding individual arbitration. The terms say this is meant to be read broadly, and that it covers any legal theory, including contract, tort, statute, fraud or misrepresentation. Disputes expressly include ones that arose before these or any prior terms (including advertising claims), ones now the subject of purported class action litigation in which you are not a member of a certified class, and ones that arise after the terms end.

Completing the informal process is required before arbitration; limitation periods are paused meanwhile
Completing this Mandatory Informal Dispute Resolution Process is a condition precedent to starting a claim in arbitration. If there is a question about whether a notice is sufficient or the process was followed, either party can ask a court to decide it, and any arbitration is stayed. The court can enforce the condition, including by enjoining the filing or prosecution of arbitrations and the assessment or collection of arbitration fees. A party can still seek damages for non-compliance in arbitration. All applicable limitation periods, including statutes of limitations, are tolled from receipt of a completed notice until the process ends, and either side may start arbitration if the Dispute is not resolved.

An arbitrator may award on an individual basis any relief a court could, including injunctive or declaratory relief only in favor of the individual party seeking it and only as far as needed for that party's own claim. You and Starbucks agree each may bring claims only in an individual capacity, not as a plaintiff or class member in any purported class, collective, consolidated, private attorney general or representative proceeding, and an arbitrator may not consolidate more than one person's claims or preside over such proceedings unless both agree. The arbitrator must follow and enforce these terms as a court would. If, after all appeals, these prohibitions on non-individualized relief and on class, collective, consolidated, private attorney general or representative proceedings are held unenforceable for a particular claim or relief request, such as public injunctive relief, that claim or request is decided by a court after the other claims are arbitrated. The arbitrator issues a reasoned written decision.

you and we agree that each may bring claims against the other only in your or our individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, private attorney general, or representative proceeding
unless both you and we agree otherwise, an arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of class, collective, consolidated, private attorney general, or representative proceeding
then such a claim or request for relief will be decided by a court of competent jurisdiction, after all other claims and requests for relief are arbitrated
The arbitrator shall issue a reasoned written decision sufficient to explain essential findings and conclusions.
Qualifications & exceptions
Class and representative proceedings are barred "to the fullest extent allowable by applicable law"
Consolidation is possible only if both you and Starbucks agree
A claim found unenforceable as non-individualized goes to court after other claims are arbitrated

Rule 68 cost-shifting applies after an award; awards can be entered as judgments but do not bind other parties
After an award, the arbitrator applies the cost-shifting provisions of Federal Rule of Civil Procedure 68. Judgment on an award may be entered in any court of competent jurisdiction, except an award that has been satisfied. An award has no preclusive effect in any other arbitration or proceeding in which you are not a named party.

Arbitration fees follow the AAA fee schedule, with the parties agreeing to keep costs down in good faith
Payment of arbitration fees is governed by the AAA Rules and fee schedule. The parties say they share an interest in reducing costs and increasing efficiency, so either may elect to engage with the AAA about fees, and both (with counsel, if represented) agree to work together in good faith to keep arbitration cost-effective.

you or we may elect to engage with the AAA regarding arbitration fees, and you and we agree that the parties (and counsel, if represented) will work together in good faith to ensure that arbitration remains cost-effective for all parties
Not stated here
The AAA fee schedule is not supplied here, and the terms do not say who pays which fees in an ordinary individual arbitration; only the mediator fee in multiple-case filings is assigned to Starbucks.

If 25 or more similar Disputes are filed by coordinated counsel, special procedures apply and yours may go to court
These additional procedures apply if you choose to take part in a "Multiple Case Filing": 25 or more similar Disputes, including yours, asserted against Starbucks by the same or coordinated counsel or otherwise coordinated. In that situation the terms warn that resolution of your Dispute might be delayed and ultimately proceed in court. As part of the procedures, counsel must meet and confer in good faith to try to resolve the Disputes, streamline procedures, address the exchange of information, modify the number of Disputes to be adjudicated, and conserve resources.

In a Multiple Case Filing, cases proceed in two stages of individual arbitrations with Starbucks paying for mediation
If your claim is part of a Multiple Case Filing, limitation periods are tolled for your Dispute from when it is first submitted to the AAA until it is selected to proceed in the staged process, or is settled, withdrawn, resolved or opted out of arbitration. Stage One: if at least 100 Disputes are submitted, counsel for the claimants and for Starbucks each select 50 to proceed as individual arbitrations, each before a different arbitrator; fewer than 100 all proceed. The rest are not filed or deemed filed, and no arbitration fees are charged on them. Counsel then take part in a global mediation with a jointly selected retired federal or state judge, and Starbucks pays the mediator's fee. Stage Two: if Disputes remain, each side selects 100 more to proceed as individual arbitrations (all if fewer than 200), with no more than five cases per arbitrator, followed by a second global mediation that Starbucks also pays for. The numbers can be increased by agreement of counsel.
Supporting quotations
If your claim is part of a Multiple Case Filing, any applicable limitations periods (including statutes of limitations) shall be tolled for your Dispute from the time that your Dispute is first submitted to the AAA until your Dispute is selected to proceed as part of a staged process or is settled, withdrawn, otherwise resolved, or opted out of arbitration pursuant to this provision.
STAGE ONE: If at least 100 Disputes are submitted as part of the Multiple Case Filing, counsel for the claimants and counsel for Starbucks shall each select 50 Disputes to be filed and to proceed as cases in individual arbitrations as part of this initial staged process.
The remaining Disputes shall not be filed or deemed filed in arbitration nor shall any arbitration fees be assessed or collected in connection with those claims.
Starbucks shall pay the mediator’s fee. STAGE TWO: If the remaining Disputes have not been resolved at the conclusion of Stage One, counsel for the claimants and counsel for Starbucks shall each select 100 Disputes per side to be filed and to proceed as cases in individual arbitrations as part of a second staged process.
No more than five cases may be assigned to a single arbitrator to proceed individually.
Qualifications & exceptions
Applies only to a Multiple Case Filing of 25 or more similar Disputes
The selection of which Disputes go first is made by counsel, 50 by each side in Stage One and 100 per side in Stage Two
Limitation periods are paused from submission to the AAA until the Dispute is selected or otherwise resolved or opted out
Not stated here
The terms do not say how long the stages or mediations take, so how long an unselected Dispute waits is not stated.
Legal Rights & Agreement Rules · Restriction or exception
Disputes left after Stage Two mediation are opted out of arbitration and may go to court
After the Stage Two mediation, each remaining Dispute that is not settled or withdrawn is opted out of arbitration and may proceed in a court of competent jurisdiction under the rest of the terms. Counsel for both sides may mutually agree in writing to arbitrate some or all of the remaining Disputes individually, using the Stage Two process with random selection and optional mediation, or through another mutually agreeable process. A court has authority to enforce the Multiple Case Filing procedures, including by enjoining the filing or prosecution of arbitrations and the assessment or collection of arbitration fees.
