Arbitrator and court authority clauses contain conflicting language
All issues, including arbitrability, are for the arbitrator, except that the scope or enforceability of the Agreement to Arbitrate or interpretation of its prohibition on class and representative actions and non-individualized relief is for a court. Filing, administration and arbitrator fees are governed by the AAA Rules unless the Agreement to Arbitrate says otherwise. If the relief sought is $10,000 or less, StubHub will pay all of those fees at the user’s request, submitted by mail to the AAA with the Demand for Arbitration.
