Future loss avoidance costs are limited to device improvements within 60 days and 10% of the cyber attack payment

Future loss avoidance costs are amounts a Member spends to improve a computing device or connected home device, if incurred within 60 days after discovery of a cyber attack event and the insurer agrees in writing that the improvements would reasonably reduce the likelihood of a similar attack (the insurer will not unreasonably withhold agreement). Improvements may include hardware and software upgrades; for subscription services the insurer pays only the first 12 months. The most payable for any one cyber attack event is 10% of the insurer's Eligible Payment under the Cyber Attack coverage, before any payment under this coverage, excluding any deductible; a payment for hardware replacement or upgrades under the system restoration costs definition reduces what is payable.

Improvements involving services subject to lease, license or subscription may have costs that are ongoing. In such case, the most we will pay are costs associated with the first 12 months of any such service, subject to the amount described in paragraph c. below.
The most we will pay for all future loss avoidance costs with respect to any one cyber attack event is 10% of our Eligible Payment to the Member prior to any payment under this Future Loss Avoidance coverage.

Use & Processing · Procedure

Data breach pre-notification: consult the insurer, use its suggested service provider or an approved one

For Data Breach coverage, the Member agrees to consult the insurer before notifying affected individuals; the insurer assumes no responsibility for services promised to affected individuals without its prior agreement. The insurer suggests a service provider for notification and services; if the Member prefers an alternate provider, it must be approved by the insurer and payment will not exceed what the insurer would have paid using its suggested provider. At the consultation the Member provides contact information about the affected individuals, information about the breach that may appropriately be communicated, and the scope of services desired, which may be structured to provide fewer services to more people without exceeding the limit. Data Breach is marked "Not Included" for Surfshark One+.
