What these Terms cover and who "we" are

These Terms of Use, effective August 12, 2025, are a binding contract between you and "us": Ticketmaster LLC, Live Nation Entertainment, Inc., and all of their parents, subsidiaries and affiliates. They govern your use of Live Nation's and Ticketmaster's websites and apps (including livenation.com, ticketmaster.com and ticketexchangebyticketmaster.com) and your purchase, possession, sale, acceptance or use of any of their tickets, products or services, which the Terms together call the "Marketplace." Simply holding, receiving or using a ticket falls within the Terms, not only buying one. Six other policies (Standard Purchase, Resale Purchase, Travel & Experiences, Transfer Recipient, Reseller and Privacy) are also made part of these Terms.

You and we are each a “party” and collectively we are the “parties” to the contract.

Legal Rights & Agreement Rules · Restriction or exception

Disputes go to individual binding arbitration, not court

You and Ticketmaster/Live Nation agree that any dispute or claim relating in any way to the Terms, your use of the Marketplace, or products or services sold, distributed, issued or serviced by or through them will be resolved by binding arbitration rather than in court, regardless of when the dispute arose. Both sides give up a jury trial and any right to take part in a class action lawsuit or class arbitration; claims can be brought only individually. Section 14 sets limited exceptions: either side may instead use small claims court for a claim within its jurisdiction, and this updated arbitration agreement and class waiver does not apply to disputes already filed and pending as of August 12, 2025, which keep whatever arbitration agreement (if any) already governed them.

Supporting quotations

you and we agree that any dispute or claim relating in any way to the Terms, your use of the Marketplace, or products or services sold, distributed, issued, or serviced by us or through us, will be resolved by binding arbitration, rather than in court.
This updated arbitration agreement and class action waiver applies to all such disputes or claims between us, except those already filed and currently pending as of August 12, 2025.
will remain governed by any applicable arbitration agreement or agreements that currently exist between the parties in those matters.
By agreeing to arbitration, you and we each waive any right to participate in a class action lawsuit or class action arbitration, except those already filed and currently pending as of August 12, 2025.
IRRESPECTIVE OF WHEN THAT DISPUTE, CLAIM, OR CONTROVERSY AROSE
THE PARTIES AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL
If a claim is within the jurisdiction of small claims court, either of the parties may (instead of arbitration) choose to take the claim to small claims court

Qualifications & exceptions

  • Exceptions are limited to those in Section 14; the full procedure (informal resolution, JAMS rules, fees, appeal) is explained in the Section 14 cards.

Changed Terms bind you only once you agree to them

Ticketmaster may update these Terms and its Other Policies from time to time (Section 11). Any change binds you only if and when you agree to the updated Terms. The Effective Date at the top shows when the Terms were last revised, and a Download Prior Version link gives the previous version. If the Terms were updated from a version you previously agreed to, the most recent version you agreed to is the one that governs you.

Supporting quotations

From time to time, we may update these Terms and our Other Policies, as detailed in Section 11, below.
Any changes we make will only be binding on you if and when you agree to the updated Terms.
The Effective Date above will tell you when the Terms were last revised, and the Download Prior Version link will take you to the prior version of the Terms.
To the extent that these Terms have been updated from a prior version of the Terms to which you previously agreed, the most recent version of the Terms to which you agreed supersedes and governs.

Qualifications & exceptions

  • The agreement-before-binding rule is stated for the updated Terms; whether a change to an incorporated Other Policy needs separate agreement is not stated.

Not stated here

  • The Terms do not say how agreement to an updated version is given (for example a click-through or continued use).

You may not imply that your User Content is sponsored or endorsed by Ticketmaster or any third party. Content & IP Rights · Permission or license

You give Ticketmaster a perpetual, irrevocable license to use your posts for any purpose

By posting, uploading or submitting User Content you grant Ticketmaster a license to access, store, transmit, use, reproduce, create derivative works of, distribute, publicly perform, display, reformat, incorporate into advertisements and other works, promote, archive and modify it, in its sole discretion and for any purpose, in any media now known or later developed. The license is royalty-free, transferable, sub-licensable, assignable, perpetual, worldwide and irrevocable. It includes the right to make your content available to, and pass these rights to, others Ticketmaster contracts with for operating the Marketplace, and to give third parties access to or disclose your content at its sole discretion. Other users may comment on or tag your content. The stated reason is to operate the Marketplace without its actions being legal violations, but the grant itself is not limited to that purpose.

Account & Service Control · Restriction or exception

Breaking the Code can mean account loss, revoked tickets and no fee refunds

The Code of Conduct rules are not exhaustive and Ticketmaster says it may modify them at any time. It may take appropriate steps to enforce them to protect the Marketplace's integrity, including suspending or terminating your account and revoking your tickets. If orders are canceled or tickets revoked because you violated the Code of Conduct, you may not be refunded the related fees.

Qualifications & exceptions

  • "May not be refunded" is permissive: a refund of fees is not ruled out in every case.

Not stated here

  • The Terms speak of fees; whether the ticket price itself is refunded on cancellation is not stated here and may be governed by the unsupplied purchase policies.

Cross-references

  • contrast (model-proposed): Changed Terms bind you only once you agree to them — contrast: The Code of Conduct says Ticketmaster may modify its rules at any time, while the change notice says changes bind you only if and when you agree to the updated Terms. Account & Service Control · Restriction or exception

Ticketmaster can suspend or end your account for any reason and cancel related orders

Ticketmaster may terminate or suspend your account and/or your access to the Marketplace at any time, for any reason. If it has reason to believe you violated the Terms or any Other Policy, it may also: (1) stop you from using the Marketplace or re-registering under another name or email; (2) cancel any order or purchase acquired through your account; (3) refuse to honor pending and future purchases, ticket postings or sales from any account it believes may be associated with you; (4) cancel tickets or orders of any person it believes is acting with you; and (5) use any other legal or contractual remedy, consistent with the Section 14 arbitration agreement. Qualifications & exceptions

Not stated here

  • Whether the ticket price (as opposed to fees) is refunded when orders are canceled is not stated here.

Liability limits: no indirect damages, and a cap of $100 or 12 months of payments

Who counts as an "Event Organizer"

Throughout the Terms, "Event Organizer" means the people who put on events, such as artists, venues, teams, fan clubs, promoters, record labels, leagues and sponsors. It matters for presale codes (only codes sent by Ticketmaster or the Event Organizer may be used), Standard Tickets (sold for the first time on the Event Organizer's behalf) and the indemnity, which also protects Event Organizers.

The arbitration agreement: who, what, and its three exceptions

Except as Section 14 provides, any dispute, claim or controversy relating in any way to the Terms or your use of the Marketplace, which includes all products or services sold, distributed, issued or serviced by or through Ticketmaster, must be resolved solely by binding arbitration rather than in court, no matter when it arose. Both parties waive any right to a jury trial and may bring claims against each other only individually, not as a plaintiff or class member in any purported class proceeding. The limited exceptions are: (1) a claim within small claims court jurisdiction may instead go to small claims court in your county of residence or the one closest to it, and you may also choose the Los Angeles County small claims court; (2) if the arbitration agreement is held unenforceable, litigation goes to Los Angeles County courts (see the venue card); and (3) the updated agreement does not apply to disputes already filed and pending as of August 12, 2025, which may or may not be arbitrable under whatever agreement already governs them.

Supporting quotations

THE PARTIES AGREE THAT, EXCEPT AS PROVIDED BELOW, ANY DISPUTE, CLAIM, OR CONTROVERSY RELATING IN ANY WAY TO THE TERMS OR YOUR USE OF THE Marketplace, which includes all PRODUCTS OR SERVICES SOLD, DISTRIBUTED, ISSUED, OR SERVICED BY OR THROUGH US
WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AS SET FORTH IN THE TERMS, RATHER THAN IN COURT.
BY AGREEING TO ARBITRATION, THE PARTIES AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT YOU AND WE MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS PROCEEDING.
Exceptions. This arbitration agreement and class action waiver shall be subject to these limited exceptions:
If a claim is within the jurisdiction of small claims court, either of the parties may (instead of arbitration) choose to take the claim to small claims court in your county of residence or in closest proximity to your residence; you may also choose to take the claim to small claims court in the Superior Court of California, County of Los Angeles.
This updated arbitration agreement and class action waiver does not apply to any disputes or claims already filed and currently pending as of August 12, 2025.

If arbitration is unenforceable, suits go only to Los Angeles County courts

If the arbitration agreement is for any reason held unenforceable, any litigation against Ticketmaster (other than small claims actions) may be started only in a federal or state court located in Los Angeles County, California, and both you and Ticketmaster consent to those courts' jurisdiction.

Supporting quotations

If this arbitration agreement in the Terms is for any reason held to be unenforceable, any litigation against us (except for small claims court actions) may be commenced only in a federal or state court located within Los Angeles County, California, and you and we each consent to the jurisdiction of those courts for such purposes.

Qualifications & exceptions

  • For Illinois event resale disputes, the Terms separately add consent to Illinois jurisdiction for court proceedings if arbitration is held unenforceable.

Before arbitration or small claims: written notice and a personal conference

Before either side may start an arbitration or a small claims case, it must go through informal dispute resolution. The claimant gives written notice: you email Live Nation Entertainment at disputes@ticketmaster.com with your full name, the email and mailing address on your Live Nation or Ticketmaster account, your lawyer's name and contact details if you have one, and a brief description of your claims and the relief you want; Ticketmaster notifies you at the email address it has on file. The parties must then personally meet and confer by phone or video conference in good faith; lawyers may take part. The conference must happen within 60 days of receipt of the notice unless both agree to extend. Only if the dispute is still unresolved after that conference may the claimant file. What is said in the process is confidential and inadmissible later (though otherwise admissible evidence stays admissible), and any statute of limitations is paused meanwhile. The disputes@ address is monitored only for dispute and arbitration notices.

Supporting quotations

the parties agree that, before a party may commence an arbitration or assert a claim in small claims court, they will engage in the following informal dispute resolution process:
To notify us that you intend to initiate informal dispute resolution, you must send an email to Live Nation Entertainment, Inc. at disputes@ticketmaster.com, providing: your full name; the email address and mailing address associated with your Live Nation or Ticketmaster account; your counsel’s name and contact information, if you are represented by counsel; and a brief description of your claim(s) and the relief sought.
To notify you that we intend to initiate informal dispute resolution, we will email you at the email address that we have on file for you
Please note that the disputes@ticketmaster.com email address is only monitored for notices to initiate informal dispute resolution or to commence arbitration
The parties will then personally meet and confer, via teleconference or videoconference, in a good faith effort to informally resolve any claim covered by this mutual arbitration agreement. If either party is represented by counsel, that party’s counsel may participate in the informal dispute resolution conference.
All offers, promises, conduct, and statements made in the course of the informal dispute resolution process by any party, its agents, employees, and attorneys are confidential and not admissible for any purpose in any subsequent proceeding
provided that evidence that is otherwise admissible or discoverable shall not be rendered inadmissible or non-discoverable as a result of its use in the informal dispute resolution process.
The informal dispute resolution conference shall occur within sixty (60) days of receipt of the written notice described above, unless an extension is mutually agreed upon by the parties.
If, after participating in that conference, the parties have been unable to resolve the dispute, the claimant may commence an arbitration or assert a claim in small claims court in accordance with this arbitration agreement.
Any statute of limitations will be tolled while the parties engage in the informal dispute resolution process described in this section.

Qualifications & exceptions

  • "Personally meet and confer" indicates the party itself, not only a lawyer, takes part.

Not stated here

Federal Arbitration Act and federal law govern; state arbitration law does not

The arbitration agreement is governed in all respects by the Federal Arbitration Act (9 U.S.C. § 1 et seq., the "FAA"), including its procedural provisions, so the FAA controls how the agreement and its class action waiver are interpreted and enforced. State arbitration laws do not govern in any respect. You and Ticketmaster agree the Terms evidence a transaction involving interstate commerce and are governed by federal law to the fullest extent possible. One stated exception: notwithstanding this governing-law provision, arbitrator selection follows applicable law, including specified California Code of Civil Procedure sections.

What an arbitrator can award, and limited court review

Arbitration has no judge or jury, and court review of an award is limited under the FAA. But the arbitrator can award, on an individual basis, the same damages and relief a court could, including injunctive and declaratory relief and statutory damages, and must follow the Terms as a court would. The arbitrator can also award public injunctive relief if the law authorizes it and the individual claim warrants it.

However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the Terms as a court would.
For the avoidance of doubt, the arbitrator can award public injunctive relief if authorized by law and warranted by the individual claim(s).

Qualifications & exceptions

  • A limited appeal to a three-arbitrator JAMS panel exists for injunctive relief decisions only.

JAMS runs the arbitration; 75+ coordinated claims follow mass-arbitration rules

Any arbitration is administered by JAMS under its Streamlined Arbitration Rules & Procedures and, if applicable, its Mass Arbitration Procedures and Guidelines in effect when the arbitration is filed, except as the Terms modify them. A Mass Arbitration means 75 or more similar demands against the same or related parties by individual claimants represented by the same law firm or coordinating firms. In a Mass Arbitration, JAMS may appoint a Process Administrator to decide preliminary and administrative matters. The parties agree those mass procedures do not include mandatory mediation or test cases and do not turn individual arbitrations into representative or class arbitrations.

Arbitrator selection follows California law; equitable claims are split into liability then relief

Notwithstanding conflicting JAMS rules and notwithstanding the federal governing-law provision, arbitrator selection proceeds under applicable law, including Cal. Civ. Proc. Code §§ 1281.9 and 1281.91(b)(1). For efficiency, if a claim seeks equitable relief such as an injunction, the arbitrator must bifurcate the proceeding: rule on liability first, before any proceedings (including discovery) about the appropriate relief.

The arbitrator decides disputes about the Terms themselves, except which version you agreed to

To the extent the law permits, the arbitrator, not any court or agency, has exclusive authority to resolve all disputes about the interpretation, applicability, enforceability or formation of the Terms, including any claim that all or part of the Terms is void or voidable. But if there is a dispute about which particular version of the Terms you agreed to, a court decides that question before the arbitration begins. The arbitration agreement is meant to be broadly interpreted and survives termination of the Terms.

The arbitrator, and not any federal, state or local court or agency, shall have exclusive authority to the extent permitted by law to resolve all disputes arising out of or relating to the interpretation, applicability, enforceability, or formation of the Terms, including, but not limited to, any claim that all or any part of the Terms is void or voidable;

Only injunctive-relief decisions can be appealed, to a three-arbitrator JAMS panel within 21 days

Court review of an arbitration decision is limited under the FAA, but the Terms add a limited appeal: within 21 days of the decision, any party may appeal the arbitrator's grant or denial of injunctive relief to a panel of three JAMS arbitrators. Except as the Terms provide otherwise, the appeal follows the JAMS Optional Arbitration Appeal Procedure. To appeal, a party submits a Demand for Arbitration and a copy of the Terms to JAMS and notifies the other side as for an arbitration. The panel consists of retired state or federal judges or licensed attorneys with at least 20 years of active litigation experience and substantial expertise in the relevant law, and it reviews the decision de novo. There is no appeal from the panel's decision except as the FAA provides, and decisions not involving injunctive relief cannot be appealed under this procedure.

Illinois event resale disputes: arbitration still applies, plus consent to Illinois courts

Solely to comply with the Illinois Ticket Sale and Resale Act (815 ILCS 414/1.5 et seq.), if your dispute concerns the resale of a ticket for an event in Illinois, you may submit your complaint to JAMS as an arbitration demand, to be decided by an independent arbitrator under the Terms. You also agree to submit to Illinois jurisdiction for complaints involving a ticketed event held in Illinois. That consent does not waive the agreement to arbitrate or its scope; it applies only to court proceedings connected with an arbitration (such as a motion to enforce an award) or if the arbitration agreement is held unenforceable. This sits alongside the general rule that, if arbitration is unenforceable, litigation may be brought only in Los Angeles County courts. Illinois resale inquiries go to 550 W. Van Buren Street, 13th Floor, Chicago, Illinois 60607 or (877) 446-9450.

does not in any way waive your and our agreement to arbitrate, or the scope of arbitration, but simply means that—for any court proceeding that may take place in conjunction with an arbitration (e.g., a motion to enforce an arbitration award), or in the event the arbitration agreement is held unenforceable—you agree to submit to jurisdiction in Illinois.

Which document wins in a conflict; arbitration always prevails

If these Terms conflict with an Other Policy, the Other Policy governs on that point. Promotions (sweepstakes, contests, games or other promotions offered by Ticketmaster or its partners) have their own rules, which you become subject to by participating; they may restrict transferring tickets, Extras and prizes, and they control over any conflicting Other Policy or Terms.
