Legal Rights & Agreement Rules · Procedure
Arbitration is governed by the FAA, with Texas law as backup
The Federal Arbitration Act governs the arbitration agreement; if the FAA does not apply to an issue, Texas law applies regardless of choice-of-law principles. California residents’ arbitrations are administered by ADR Services, Inc.; residents elsewhere by National Arbitration and Mediation under its Comprehensive Dispute Resolution Rules or Supplemental Rules for Mass Arbitrations. If the provider is unavailable, the parties choose an alternative or ask a court to appoint an arbitrator, and the arbitration agreement controls over provider rules where they conflict.

If you live in California, the arbitration will be administered by ADR Services, Inc.
If you live outside of California, the arbitration will be administered by National Arbitration and Mediation

Legal Rights & Agreement Rules · Procedure
The initiating party pays filing fees; frivolous claims can shift fees

Bumble pays filing fees for in forma pauperis users who cannot get a waiver
A user may qualify for a waiver of certain arbitration costs under the provider’s rules or other law. If the user meets the in forma pauperis standard in federal court, Texas state court or their state’s courts, cannot obtain a filing-fee waiver from the provider, and the provider refuses to administer the arbitration without payment, the Bumble Group will pay the filing fees.

The arbitrator decides arbitrability and remedies; awards are final
The arbitrator has exclusive authority over threshold arbitrability issues, including whether the agreement is applicable, enforceable or unconscionable. Courts have exclusive authority over severance, enforceability of the mass arbitration procedures, compliance with conditions precedent, and availability of an arbitration provider. The arbitrator may grant dispositive motions, award monetary damages and any non-monetary relief available individually, and issues a written award that is final and binding.

All other claims shall be arbitrated.
This subsection does not prevent you or Bumble from participating in a class-wide settlement of claims.
Mass Filing protocols apply when 30 or more similar arbitration demands are made
If 30 or more similar demands for arbitration are asserted against Bumble or related parties by the same or coordinated counsel or entities, or Bumble asserts 30 or more similar demands or counterclaims against similarly situated parties, within 60 days or otherwise close in proximity, it is a Mass Filing and additional protocols apply.

Legal Rights & Agreement Rules · Restriction or exception
Mass Filing demands get extra protocols, delay and tolled limitation periods
A demand that fits the Mass Filing definition is subject to the additional protocols. If the parties disagree whether filings fit the definition, the arbitration provider decides. The parties acknowledge that adjudication may be delayed and that any statute of limitations is tolled from the time of filing of the demand and pending resolution of the bellwether proceedings.
Supporting quotations
then you and we agree that the demand for arbitration shall be subject to the additional protocols set forth in this Mass Filings subsection
If the parties disagree as to whether a series of filings fits within the definition of Mass Filing above, the arbitration provider shall resolve the disagreement.
the adjudication of the dispute may be delayed and that any applicable statute of limitations shall be tolled from the time of filing of the demand for arbitration, and pending resolution of the bellwether proceedings
Bellwether process: ten test cases proceed and other mass claims wait
In a Mass Filing, the parties select ten individual claims (five per side) as Initial Test Cases, and only those are filed with the arbitrator. All other claims are held in abeyance, with filing fees payable only for the test cases; neither side is in breach or subject to remedies for not paying deferred fees. Unless resolved or extended, arbitrators render final awards for the test cases within 120 days of the initial pre-hearing conference.
Supporting quotations
The parties shall select ten individual arbitration claims (five per side), designated the “Initial Test Cases,” to proceed to arbitration. Only the Initial Test Cases shall be filed with the arbitrator. All other claims shall be held in abeyance.
the filing fees will be paid only for the Initial Test Cases
neither you nor we shall be deemed to be in breach of this Arbitration Agreement for failure to pay any such filing fees
the arbitrators will render a final award for the Initial Test Cases within 120 days of the initial pre-hearing conference
Global mediation follows test cases, with a 90-day window and court opt-out
After the Initial Test Cases, the parties engage in a global mediation of remaining claims, deferring filing costs. The mediator and parties have 90 days after the final awards to agree on a methodology and make an offer. If unresolved, the parties may opt out of arbitration and proceed in court with written notice within 60 days of the close of mediation; absent opt-out, the arbitrations may then be filed and administered under the Batch Arbitration provision unless the parties agree otherwise in writing. The statute of limitations is tolled pending the mediation.
Supporting quotations

the mediator and the parties shall have 90 days to agree upon a substantive methodology and make an offer to resolve the outstanding cases
the Parties may choose to opt out of the arbitration process and proceed in court with the remaining claims
Notice of the opt-out shall be provided in writing within 60 days of the close of the Global Mediation.
any applicable statute of limitations shall be tolled pending resolution of the global mediation process
Batch Arbitration: remaining demands go in batches of 100 per arbitrator
If a Mass Filing is not resolved by the bellwether and global mediation processes, the arbitration provider will administer the remaining demands in batches of 100, appoint one arbitrator per batch, and resolve each batch as a single consolidated arbitration with one set of fees per side, one procedural calendar, one hearing (if any) in a place to be determined by the arbitrator, and one final award. If the provider will not administer it that way, its mass arbitration fee schedule applies.
