Nintendo need not monitor content but may access, use, monitor, disclose or preserve your information in set cases

The Terms say there is no promise that the Services will not contain content the Terms prohibit. Nintendo has no obligation to screen, edit or monitor User Content, but reserves the right, with absolute discretion, to access, use, monitor, disclose or preserve information associated with your use of the Services, including User Content and information it acquires about you through your use. It may do so when it forms a good faith belief that this is necessary to comply with applicable law or respond to legal process from competent authorities; to enforce the Terms or protect the rights or property rights of Nintendo or its users; to help prevent a loss of life or serious physical injury to anyone; or to prevent potentially illegal or offensive activities.
