American Express may obtain credit reports and other information and use it for any purpose, including marketing

The Card Member agrees that American Express will obtain credit reports, investigate the ability to pay, and obtain information from other sources, including information to verify and re-verify employment and income. The Card Member agrees that American Express will use that information for any purposes (for example, marketing or evaluating the Card Member for a new account), subject to applicable law. The Card Member also agrees that American Express will give information about the Account to credit reporting agencies and will tell a credit reporting agency if the Card Member fails to comply with the Agreement, which may negatively affect the Card Member's credit report.
