If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential and not disclose it to any third party. Materials you provide to us

KWS may allow you to post, submit, publish, display, or otherwise transmit (Submit) content or materials (Content) on or through KWS. You are solely responsible for securing and backing up Content that you Submit.

You represent and warrant that you own or otherwise control all of the rights to your Content at the time you Submit it and that the Content does not violate these Terms or the rights (intellectual property rights or otherwise) of any third party.

Content you Submit must not breach our Content Guidelines. You represent and warrant that any Content you Submit complies with our Content Guidelines.

We have the right but not the obligation to monitor and edit or remove any Content. Unless restricted by applicable law, we also have the right to disclose your identity to any third party who is claiming that Content that you Submit constitutes a violation of their intellectual property rights, or of their right to privacy.

You will have sole responsibility for the legality, reliability, integrity, accuracy and quality of any personal data you provide to us through KWS. Other than any personal information which will be dealt with in accordance with our Privacy Policy, any Content that you Submit will be considered non-confidential and non-proprietary and you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable and fully sublicensable licence, to use, copy, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your Content in any media.

Moderating Usernames

For some games/services powered by KWS technology, we moderate usernames during the child account creation process to ensure they follow our Content Guidelines. You can also flag usernames that are illegal or otherwise in breach of these Terms or Content Guidelines using this form. We use a combination of automation and human review to identify usernames that violate our Content Guidelines. We will review reported usernames and consider each situation contextually and carefully before any action is taken.

Content Guidelines

We do not allow content that is illegal, fraudulent, deceptive, obscene, threatening, defamatory, invasive of privacy, infringes on intellectual property rights, or otherwise harms others. Content on our service must not contain software viruses, commercial solicitation, chain letters, mass mailings, or any form of “spam.”

Do not rely on information within KWS

The content within KWS is provided for general information and use only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content within KWS. It shall be your own responsibility to ensure that any products, services or information available through KWS meet your specific requirements. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered within KWS for any particular purpose. You acknowledge that the information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. Your use of any information or materials on or made available through KWS is entirely at your own risk, for which we shall not be liable.

We are not responsible for viruses and you must not introduce them

We do not guarantee that KWS will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access KWS. You should use your own virus protection software. You must not misuse KWS by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to KWS, the server on which KWS is stored or any server, computer or database connected to KWS. You must not attack KWS via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use KWS will cease immediately.

This section only applies to the extent permitted by applicable law. If you are prohibited by law from entering into the indemnification obligation below, then you assume, to the extent permitted by law, all liability for all claims, demands, actions, losses, liabilities, and expenses (including legal fees, costs and expert witnesses’ fees) that are the stated subject matter of the indemnification obligation below.

You agree to defend, indemnify, and hold harmless Kids Web Services Ltd, its affiliates, and licensors, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) resulting from your Content or violation of these Terms. This means you will be responsible for any loss or damage we and our associated parties’ suffer as a result of your Content or breach of these Terms.

Disclaimers and limitations of liability

Nothing in these Terms will affect the statutory rights that you may have as a consumer of KWS and we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

Some countries, states, provinces or other jurisdictions do not allow the exclusion of certain warranties or the limitation of liability as stated in this section, so the below terms may not fully apply to you. Instead, in such jurisdictions, the exclusions and limitations below shall apply only to the extent permitted by the laws of such jurisdictions.

KWS and all information, content, materials, products (including the Parent Portal), software, and other services included on or otherwise made available to you through KWS are provided by us on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied. You expressly agree that your use of KWS is at your sole risk. To the fullest extent permissible by law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant that KWS, information, content, materials, products (including the Parent Portal), software, or other services included on or otherwise made available to you through KWS, our servers, or electronic communications sent from us are free of viruses or other harmful components, will meet your or any other person’s requirements, operate without interruption, achieve any intended result, be compatible or work with any software, system or other services or be secure, accurate, complete, free of harmful code or error free.

To the fullest extent permissible by law, we will not be liable for any loss of profits, sales, business, or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation or any indirect, incidental, punitive, special or consequential damages arising out of or in connection with KWS or these Terms. Further, to the fullest extent permissible by law, our aggregate liability arising out of or in connection with these Terms will not exceed one hundred pounds sterling (£100). These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation.

We are not responsible for websites we link to

From time to time, KWS may include links to other websites or digital services provided by third parties. These links are provided for your convenience to provide further information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Additional terms

To the fullest extent permitted by law, the controlling language for these terms is English. Any translation has been provided for your convenience only.

No waiver of these Terms by us shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms will continue in full force and effect.

We may transfer our rights and obligations under these terms to another organisation.

No one other than us or you has any right to enforce any of these Terms.

If you are a consumer, these Terms, their subject matter and their formation, are governed by English law. ConnectID® Terms

These terms apply if you use ConnectID to verify your age. By choosing ConnectID as your verification method, you agree to these terms. We handle any personal information you give us in line with our Privacy Policy.

How ConnectID works

KWS is part of the ConnectID Network. This lets you ask your bank to confirm your age to us. Your bank only tells us whether you are 16+ or 18+. It does not share your name, address, date of birth, banking information or any other personal information about you.

The ConnectID Network enables the transfer of age information between us and your bank. However, ConnectID Pty Ltd or its related bodies corporate (ConnectID) does not access or hold your age information. The transfer happens directly from the bank to us.

Any transfer of age information from the bank to us is at your request and option. Your chosen bank will only share your age information with your express consent. If you do not consent, the age verification will not be performed and we will offer you another way to verify your age.

Each age verification with ConnectID is a one-off transfer of age information from your bank to KWS. Any further transfers of age information from the bank require further consent from you and a new age verification request, even if you ask the same bank.

We do not charge you to verify your age.

When you can use ConnectID

ConnectID is only available in Australia, and only if the Partner has chosen to offer it as a verification option. You can only verify your age using ConnectID if (i) you have an active digital account with one of the banks that is part of the ConnectID Network, listed here, (ii) you have verified your identity with your bank within the prior 5 years, and (iii) you meet the minimum age requirements set out in your bank’s terms of service for ConnectID.

Customer acknowledgments

You acknowledge and agree that:

We hold the exclusions in this section that relate to ConnectID on trust for ConnectID. This means that, although ConnectID is not a party to these terms, it can rely on your agreement to these exclusions.

Age verifications using ConnectID are intended to operate separately from requests made under the Consumer Data Right scheme. We do not participate in that scheme.

Withholding service

We may withdraw or suspend the ConnectID verification method at any time. We or your bank may also be unable to offer ConnectID or process an age verification request for a number of reasons, including if:

Your Rights

Our Privacy Policy explains your rights relating to your personal information and how to exercise them. You can exercise your rights at any time by emailing privacy@kidswebservices.com. Exercising your rights with us will not impact your record with your bank. You will need to contact your bank separately if you want to exercise your rights in respect of the personal information they hold about you. If you suspect fraud in relation to any verification, you must notify us as soon as possible.

Complaints

For complaints or disputes relating to our participation in the ConnectID Network, please contact us at privacy@kidswebservices.com. However, if your complaint or dispute relates to activities of the bank that you asked to disclose age information to us, we may direct you to contact your bank directly.
