Nintendo pays filing fee differences, and all arbitration fees if the claim is non-frivolous and under $75,000
The arbitration rules are available from the AAA's website or by phone. To the extent the initial filing fee for the arbitration exceeds the initial filing fee for a lawsuit, Nintendo will pay the difference. If the arbitrator finds the arbitration non-frivolous, Nintendo will pay all actual filing and arbitrator fees for the arbitration, provided your claim is less than $75,000. The arbitration rules also permit you to recover attorney's fees in certain cases.
