App Store Notice

Notice Regarding App Stores

When you download our app from an app store, such as the AppleApple App Store or GoogleGoogle Play, please note that:

• The points below apply when you download the app from an app store Legal Rights & Agreement Rules

• these terms are concluded between us, and not with the app store, and we are responsible for the app (not the app store);
• • Your terms are concluded with Roku, not the app store, and Roku is responsible for the app Legal Rights & Agreement Rules
• the app store has no obligation to furnish any maintenance and support services for the app;
• • The app store has no obligation to provide maintenance or support for the app Legal Rights & Agreement Rules
• in the event of any failure of the app to conform to any applicable warranty, (1) you may notify the app store and the app store will refund the purchase price for the app to you (if applicable), (2) to the maximum extent permitted by applicable law, the app store will have no other warranty obligation whatsoever with respect to the app, and (3) any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our responsibility;
• • On a warranty failure the app store refunds the price and Roku carries the other warranty claims Charges & Financial Obligations
• the app store is not responsible for addressing any claims you have or any claims of any third party relating to the app or your possession and use of the app, including, but not limited to: (1) product liability claims; (2) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (3) claims arising under consumer protection or similar legislation;
• • The app store does not address claims about the app, including product-liability and consumer-protection claims Legal Rights & Agreement Rules
• in the event of any third party claim that the app or your possession and use of that app infringes that third party’s intellectual property rights, we will be responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by these terms;
• • Roku handles third-party claims that the app infringes intellectual property, as far as the terms require Content & IP Rights
• you are representing that you are not located in a country that is subject to an embargo, that has been designated as a "terrorist supporting" country, or is on any list of prohibited or restricted parties, by the US government or your country’s government;
• • You represent that you are not in an embargoed country or on a prohibited-party list Legal Rights & Agreement Rules
• you must also comply with all applicable third-party terms of service when using the app; and
• • You must comply with applicable third-party terms of service when using the app Legal Rights & Agreement Rules
• the app store, and its subsidiaries, are third party beneficiaries of these terms as it relates to your license of the app, and that, upon your acceptance of the terms and conditions of these terms, the app store will have the right (and will be deemed to have accepted the right) to enforce these terms as related to your license of the app against you as a third party beneficiary thereof.
