Total liability is capped at the greater of $100 or what you paid TikTok in the past 12 months

To the extent permitted by applicable law, the maximum aggregate liability of TikTok USDS Joint Venture and its affiliates, service providers and business partners (including TT Commerce & Global Services and its affiliates) and their officers, directors, employees, agents and advisors, arising out of or relating to the Terms or your use of the Platform is capped, under no circumstance, at the greater of $100 or the amount you have paid TikTok in the past 12 months.

To the extent permitted by applicable law, the maximum aggregate liability of TikTok USDS Joint Venture and our affiliates, service providers and business partners, including TT Commerce & Global Services, and its affiliates, and each of our respective officers, directors, employees, agents, and advisors, arising out of or relating to these Terms or your use of the Platform shall, under no circumstance, exceed the greater of $100 or the amount you have paid us in the past 12 months.
