Most disputes go to an informal process, small claims court or individual arbitration, not jury or class actions

The Agreement requires you and AT&T to resolve most disputes through an informal dispute resolution process, in small claims court, or through arbitration on an individual basis rather than through jury trials or class actions. The informal process lets you explain what happened to someone in, or working with, AT&T's legal department. In arbitration a neutral arbitrator decides the dispute, applies the same law and can award the same individualized remedies as a court, using streamlined procedures; the decision is legally binding and subject only to limited court review.

Supporting quotations

It requires you and AT&T to resolve most disputes through an informal process, in small claims court, or through arbitration on an individual basis rather than jury trials or class actions.
The informal dispute resolution process gives you the opportunity to explain what happened to someone in, or working with, our legal department.
The arbitrator applies the same law and can award the same individualized remedies that a court could award but uses streamlined procedures and discovery to simplify the process and reduce costs.
The arbitrator’s decision is legally binding, and it is subject to limited review by courts.

Qualifications & exceptions

  • "Most disputes": claims for bodily injury or death are excluded from arbitration (1.3.2.1), either side may use small claims court, and agency complaints remain available.
  • The arbitrator's decision is binding with limited court review.

Legal Rights & Agreement Rules · Restriction or exception

You and AT&T agree to arbitrate all disputes except bodily injury or death claims

To the greatest extent the Federal Arbitration Act permits, you and AT&T agree to arbitrate all disputes and claims between you, except claims arising from bodily injury or death. The scope is meant to be read broadly and includes claims about any aspect of the relationship under any legal theory, claims that arose before this or any prior Agreement (including advertising claims), claims for mental or emotional distress not arising from bodily injury, claims in purported class actions where you are not a member of a certified class, and claims arising after the Agreement ends. Exceptions and limits elsewhere: either side may take an individual dispute to small claims court; you may still bring issues to federal, state or local agencies such as the FCC; certain issues (such as arbitrability and enforceability) are reserved for a court; in a mass arbitration a dispute not resolved in the staged process may be opted out to court, and it goes to court if the staging process is held unenforceable; and you may reject future changes to the arbitration provision within 30 days of notice. The arbitration provision survives termination.

Supporting quotations

To the greatest extent permitted under the Federal Arbitration Act, AT&T and you agree to arbitrate all disputes and claims between you and AT&T, except for claims arising from bodily injury or death.
The scope of this arbitration provision is intended to be broadly interpreted.
claims arising out of or relating to any aspect of the relationship between us, whether based in contract, tort, fraud, misrepresentation, or any other statutory or common-law legal theory;
claims that arose before the existence of this or any prior Agreement (including, but not limited to, claims relating to advertising);
claims for mental or emotional distress or injury not arising out of bodily injury;
claims that are currently the subject of purported class action litigation in which you are not a member of a certified class; and
claims that may arise after the termination of this Agreement.
This arbitration provision does not preclude you from bringing issues to the attention of federal, state, or local agencies, including, for example, the Federal Communications Commission.
This arbitration provision will survive termination of this Agreement.
You and AT&T may, separately or by agreement, opt out of arbitration and elect to have your dispute heard in a court of competent jurisdiction consistent with the remainder of the Agreement (including the rest of Section 1).
then your dispute will not proceed in arbitration. Instead, it will proceed only in a court of competent jurisdiction
you may reject any such change by sending us written notice via U.S. Mail within 30 days of the first notice of the change

Qualifications & exceptions

  • Excludes claims arising from bodily injury or death.
  • Small claims court option for individual claims (Small Claims Option).
  • Agency complaints, for example to the FCC, are not precluded.
  • Mass-arbitration Option One allows opting a dispute out to court after the staged process; court proceeds if staging is held unenforceable.
  • Future changes to the arbitration provision may be rejected by mail within 30 days of the first notice.

Either side may take a dispute to small claims court in your billing county instead of arbitration

Despite the arbitration provision, you or AT&T may bring a dispute, or elect to have it heard, in the small claims court for the county (or parish) of your billing address. Such a dispute is not subject to arbitration as long as it stays in that court and advances only individual (non-class, non-representative) claims for individualized relief. The small claims court decides first whether the dispute is within its jurisdictional limits. As with arbitration, a small claims proceeding cannot begin until the informal resolution period ends.

Supporting quotations

Despite this arbitration provision, either you or AT&T may bring a dispute or elect to have a dispute heard in the small claims court for the county (or parish) of your billing address.
Disputes submitted to small claims court are not subject to arbitration, so long as they remain in that court and advance only individual (non-class, non-representative) claims seeking individualized requests for relief.
Any arbitration or small claims court proceeding cannot begin until after the Informal Resolution Period has ended.

Qualifications & exceptions

  • Only while the dispute remains in small claims court and seeks individual relief.
  • The informal dispute resolution requirement applies before a small claims case begins (1.3.2.2).

Arbitration does not stop agency complaints; the Federal Arbitration Act governs it and it survives termination

The arbitration provision does not stop you from bringing issues to federal, state or local agencies, such as the Federal Communications Commission, and those agencies can, if the law allows, seek relief against AT&T on your behalf. Because the Agreement is a transaction in interstate commerce, the substantive and procedural provisions of the Federal Arbitration Act, not state arbitration law, govern how the arbitration provision is interpreted and enforced. The arbitration provision survives termination of the Agreement.

The first formal step in any dispute is a signed written Notice of Dispute

If customer service cannot resolve a concern, the first step in the dispute process is a written Notice of Dispute; AT&T also sends one to your billing address if it has a dispute with you. The Notice can be sent by U.S. mail or courier to the stated Legal Department Notice Address in Dallas, Texas, or submitted electronically through att.com/noticeofdispute. It must include everything the Notice form asks for, including your name, address and phone number, the Account number, the services involved, a description of the claim, and the specific relief sought with the basis for its calculation. It must be personally signed by you if you are the claimant. Before AT&T discusses or shares your Account information with anyone else, including your attorney, you must give your authentication and consent.

Supporting quotations

If that does not work, the first step in the dispute resolution process is to send a written Notice of Dispute (“Notice”).
(We’ll also send you a Notice to your billing address if we have a dispute with you.)
The Notice to AT&T may be sent by U.S. mail or professional courier service to Legal Department - Notice of Dispute, AT&T, 208 S. Akard, Office #2900.13, Dallas, Texas 75202 (the “Notice Address”), or, alternatively, submitted electronically by following the instructions at
The Notice must include all of the information requested on the Notice form, including: (a) the claimant’s name, address, and phone number; (b) the Account number at issue; (c) the services (if any) to which the claim pertains; (d) a description of the nature and basis of the claim or dispute; and (e) an explanation of the specific relief sought and the basis for the calculations.
The Notice must be personally signed by you (if you are the claimant) or by an AT&T representative (if we are the claimant).
To protect your Account, you must provide your authentication and consent before we discuss or share your Account information with anyone other than you, including an attorney (“Authentication and Consent”).

Qualifications & exceptions

  • The Notice must be personally signed by the claimant (you) or an AT&T representative.
  • Authentication and Consent is required before AT&T shares Account information with anyone other than you, including an attorney.

Legal Rights & Agreement Rules · Procedure

After a Notice, the other side gets 60 days and either side can ask for a settlement call you must join personally

The party sending a Notice must give the other party 60 days after it receives a complete Notice (including Authentication and Consent, if required) to investigate. During that period the receiving party may request an individualized phone call or videoconference to discuss settlement (an Informal Settlement Conference). Both sides must cooperate in good faith to schedule it, and it may take place after the 60 days. You and an AT&T representative must personally participate unless agreed otherwise in writing; lawyers may also take part.

Filing deadlines pause during the informal resolution period

Any statute of limitations or contractual limitations period is paused (tolled) for the claims and relief stated in the Notice during the Informal Resolution Period. That period runs from receipt of the Notice (and any required Authentication and Consent) through the later of 60 days after receipt or the completion of a timely requested Informal Settlement Conference.

Supporting quotations

Any applicable statute of limitations or contractual limitations period will be tolled for the claims and requested relief in the Notice during the “Informal Resolution Period.”
The Informal Resolution Period runs from the date the Notice (and Authentication and Consent, if required) is received through the later of (1) 60 days after receipt of the Notice, or (2) the date the Informal Settlement Conference is completed, if timely requested.

Qualifications & exceptions

  • Tolling covers only the claims and requested relief stated in the Notice.

Legal Rights & Agreement Rules · Restriction or exception

No arbitration or small claims case can start until the informal process is finished

An arbitration or small claims court case cannot begin until the Informal Resolution Period has ended; mass arbitrations have additional requirements in subsection 1.3.2.7. If any informal dispute resolution requirement has not been met, a court can stop the filing or prosecution of the arbitration or small claims case, JAMS may not accept, administer or charge fees for such an arbitration unless the law prohibits that restriction, and an already pending arbitration must be dismissed. Both sides still may seek relief for non-compliance with this condition in arbitration.

Supporting quotations

Any arbitration or small claims court proceeding cannot begin until after the Informal Resolution Period has ended. (Subsection 1.3.2.7 contains additional requirements for commencing mass arbitrations.)
If any aspect of these requirements has not been met, a court of competent jurisdiction can enjoin the filing or prosecution of an arbitration or small claims court proceeding. In addition, unless prohibited by law, JAMS may not accept, administer, assess, or demand fees in connection with such an arbitration. If the arbitration already is pending, it must be dismissed.
Even so, both parties retain the right to seek relief for non-compliance with this condition precedent in arbitration.

Qualifications & exceptions

  • Mass arbitrations carry additional commencement requirements (1.3.2.7).
  • The JAMS restriction applies unless prohibited by law.

Legal Rights & Agreement Rules · Procedure

An arbitration demand must attach the Notice and a signed compliance certification and disclose funders

A form to start arbitration is available at att.com/arbitration-forms, and JAMS explains online filing. The demand must be sent to JAMS and to AT&T's Notice Address, and must attach a copy of the Notice and a certification of compliance with the informal dispute process, personally signed by the party starting arbitration and by their counsel if represented. The demand must disclose any person or entity funding, or holding a financial stake in, any aspect of the arbitration.

Supporting quotations

A copy of the arbitration demand must be sent to JAMS and the Notice Address, and a copy of the Notice and a certification of compliance with the Informal Dispute Resolution Process in subsection 1.3.2.2 (personally signed by the party initiating arbitration and their counsel, if represented) must be attached to your arbitration demand.
The arbitration demand must disclose any person or entity that is funding or has a financial stake in any aspect of the arbitration.

JAMS administers the arbitration under its streamlined rules as modified by the Agreement

JAMS administers the arbitration under its then-current Streamlined Arbitration Rules and Procedures, plus any applicable Mass Arbitration Procedures and Guidelines, as modified by this arbitration provision. If JAMS refuses to enforce any part of the provision, you and AT&T pick another provider that will administer it consistently with the provision, and a court picks one if you cannot agree. The JAMS Rules are available online or by writing to the Notice Address, and AT&T offers plain-language arbitration information at att.com/arbitration-information.

Supporting quotations

JAMS will administer the arbitration. The arbitration will be governed by the then-current JAMS Streamlined Arbitration Rules and Procedures, plus any Mass Arbitration Procedures and Guidelines that apply to the dispute (together, the “JAMS Rules”), as modified by this arbitration provision.
If JAMS refuses to enforce any part of this arbitration provision, you and AT&T will pick another arbitration provider that will administer the arbitration consistent with this arbitration provision. If the parties cannot agree, the court will pick an arbitration provider that will do so.

Legal Rights & Agreement Rules · Restriction or exception

Claims only individually: no class, collective, representative or public injunction proceedings

The arbitrator may award relief, including damages, restitution, declaratory and injunctive relief, only in favor of the individual party seeking it and only as needed for that party's individual claim. You and AT&T may bring claims against each other only in an individual capacity, not as a plaintiff or class member in any class, collective, representative or private attorney general proceeding. Unless both sides agree, the arbitrator cannot consolidate more than one person's claims or preside over any class, collective, representative, private attorney general or public injunction proceeding. Section 1.12 repeats the class action waiver for court cases too, to the greatest extent the law permits; participating in a class-wide or mass settlement is still allowed.

Supporting quotations

The arbitrator may award relief (including, but not limited to, damages, restitution, declaratory relief, and injunctive relief) only in favor of the individual party seeking relief and only to the extent necessary to provide relief for that party’s individual claim.
YOU AND AT&T AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING.
Further, unless both you and AT&T agree otherwise, the arbitrator cannot consolidate more than one person’s or entity’s claims, and cannot preside over any form of class, collective, representative, private attorney general, or public injunction proceeding.
You and AT&T agree that, to the greatest extent permitted by law, each party may bring claims (whether in court or in arbitration) against the other only in an individual capacity.
For avoidance of doubt, nothing in this or any prior Agreement prevents you or AT&T from participating in a class-wide or mass settlement of claims.

Qualifications & exceptions

  • Consolidation is barred unless both you and AT&T agree.
  • Participation in a class-wide or mass settlement is not prevented.
  • The court-case waiver in 1.12 applies to the greatest extent permitted by law.

Legal Rights & Agreement Rules · Procedure

If a court strikes the class or public-relief bans, arbitration happens first and a court handles the rest

If a court, after all appeals, decides that any ban on consolidation or non-individualized relief (such as class, representative, private attorney general or public injunctive relief) is unenforceable, all other aspects of the case must be arbitrated first, and a court then decides the remaining parts that cannot be arbitrated. Nothing in this or any prior Agreement prevents either side from participating in a class-wide or mass settlement.

Supporting quotations

If a court of competent jurisdiction (after exhaustion of all appeals) decides that any of these bans on consolidation or non-individualized relief (such as class, representative, private attorney general, or public injunctive relief) is unenforceable, then all other aspects of the case must be arbitrated first. After arbitration is done, a court will decide the remaining parts of the case that cannot be arbitrated.

Legal Rights & Agreement Rules · Restriction or exception

25 or more similar claims with coordinated lawyers trigger mass arbitration procedures that may delay your case

If 25 or more claimants, including you, submit Notices or try to file arbitration demands raising similar claims and are represented by the same or coordinated counsel, whether or not the cases are pursued at the same time, the JAMS Mass Arbitration Procedures and Guidelines apply as modified by the Agreement. You agree to this process even though it may delay the arbitration of your claim and your dispute might end up in court.

Supporting quotations

If 25 or more claimants (including you) submit Notices to AT&T or seek to file arbitration demands raising similar claims, and they are represented by the same or coordinated counsel (whether such cases are pursued simultaneously or not), you and AT&T agree that the JAMS Mass Arbitration Procedures and Guidelines apply, as modified by this Agreement.

Legal Rights & Agreement Rules · Procedure

Mass arbitrations proceed in stages of 40 test cases with mediation in between; other cases wait

In the first stage, claimants' counsel and AT&T each pick 20 cases (40 total) to be filed and decided individually by different arbitrators, from the claimants' home states if feasible; if there are fewer than 40 cases, all are filed. Meanwhile no other case may be deemed filed or proceed, and JAMS must not charge fees for, administer or accept the remaining cases. Arbitrators are encouraged to finish within 120 days of appointment. After the first stage, the parties must hold a single mediation of all remaining cases, with AT&T paying the mediation fee; if that fails, another 40 cases are selected and decided, followed by another mandatory mediation. Between stages counsel meet and confer about efficiency, and either party may talk to JAMS about the amount or timing of fees.

Supporting quotations

In the first stage, claimants’ counsel and AT&T will each select 20 cases (40 cases total) to be filed in arbitration and resolved individually by different arbitrators.
In the meantime, no other cases may be deemed filed or proceed in arbitration, and JAMS must not assess or demand payment of fees for the remaining cases or administer or accept them.
After the first stage is completed, the parties must engage in a single mediation of all remaining cases, and AT&T will pay the mediation fee. If the parties cannot agree how to resolve the remaining cases after mediation, they will repeat the process of selecting and filing another 40 cases to be resolved individually by different arbitrators, followed by mandatory mediation.
Between stages, counsel will meet and confer regarding ways to improve the efficiency of the staged proceedings

Qualifications & exceptions

  • Cases outside the current stage cannot proceed or be charged fees while staging continues.

Legal Rights & Agreement Rules · User right or choice

After two staged rounds, you or AT&T may opt a mass-arbitration dispute out to court within set deadlines

If your dispute is not resolved through the staged process, there are two options. Option One: you or AT&T may opt your dispute out of arbitration and have it heard in court under the rest of the Agreement, including Section 1 (so the Dallas forum, class action waiver and jury trial waiver in 1.12 still apply). You must send AT&T a written notice personally signed by you, clearly stating you want to opt out, within 30 days after the second mediation ends; AT&T may opt out by notice to your counsel within 14 days after your 30-day period ends; counsel may agree to change these deadlines. Option Two: if neither side timely chooses Option One, your dispute continues in staged individual arbitration with four changes: up to 100 cases per stage, picked at random, earlier arbitrators may be reused if needed, and mediation becomes optional.

Supporting quotations

If your dispute is not resolved as part of the process identified above, the parties have two options:
You and AT&T may, separately or by agreement, opt out of arbitration and elect to have your dispute heard in a court of competent jurisdiction consistent with the remainder of the Agreement (including the rest of Section 1).
To choose Option One, you must send AT&T a written notice, personally signed by you, with a clear statement that you want to opt your dispute out of arbitration. You must send the notice within 30 days after the second mediation ends. AT&T may opt your dispute out of arbitration by sending a notice of intent to opt out to your counsel within 14 days after your 30-day opt-out period ends.
If neither you nor AT&T timely choose Option One, then you agree that your dispute will be resolved as part of continuing, staged individual arbitration proceedings as described above, with four changes. First, a total of 100 cases may be filed in each stage. Second, the cases will be picked at random.
Fourth, mediation is optional at the election of counsel for the parties.

Qualifications & exceptions

  • Your opt-out notice must be personally signed and sent within 30 days after the second mediation ends.
  • In court, the rest of Section 1, including 1.12, still applies.

Legal Rights & Agreement Rules · Company commitment

Deadlines pause for disputes waiting in a mass arbitration, and courts can enforce the staging

If your dispute is part of a Mass Arbitration, statutes of limitations and contractual limitations periods are tolled from when it is first submitted to JAMS until it is picked to proceed, is settled, withdrawn or otherwise resolved, or is opted out of arbitration. A court can enforce this subsection, including by stopping the mass filing, the prosecution or administration of arbitrations, or the assessment or collection of JAMS fees.

Supporting quotations

If your dispute is part of a Mass Arbitration, any applicable statutes of limitations or contractual limitations periods are tolled for your dispute.
Tolling runs from the time your dispute is first submitted to JAMS until your dispute is picked to proceed as part of this staged process, is settled, withdrawn, otherwise resolved, or opted out of arbitration under this provision.
A court of competent jurisdiction will have the authority to enforce this subsection, including by enjoining the mass filing, the prosecution or administration of arbitrations, or the assessment or collection of JAMS fees.

Legal Rights & Agreement Rules · Restriction or exception

If the mass-arbitration staging is held unenforceable for your dispute, it goes to court instead

Both sides, and their counsel, agree to work together in good faith to carry out the mass-arbitration staging process, and each of its requirements is meant to be severable. But if a court, after all appeals, decides that the staging process applies to your dispute and is not enforceable, your dispute will not be arbitrated; it proceeds only in court, under the rest of the Agreement, including the remaining parts of Section 1.3 and Section 1.12 (governing law, Dallas forum, class action and jury trial waivers).

Supporting quotations

You and AT&T (and counsel, if represented) agree to work together in good faith to carry out the staging process. This subsection and each of its requirements are intended to be severable from the rest of this arbitration provision.
But if, after exhaustion of all appeals, a court of competent jurisdiction decides that the staging process in this subsection applies to your dispute and is not enforceable, then your dispute will not proceed in arbitration. Instead, it will proceed only in a court of competent jurisdiction, consistent with the remainder of the Agreement (including the remaining provisions of Section 1.3 and Section 1.12).

You can reject future changes to the arbitration provision by mail within 30 days

Notwithstanding anything else in the Agreement, including the general rule that continued use accepts changes, if AT&T makes any future change to the arbitration provision (other than a change to the Notice Address), you may reject it by sending written notice by U.S. Mail within 30 days of the first notice of the change to Legal Department - Revised Arbitration Opt-Out at the stated Dallas, Texas address. The notice must include your name, address, phone number, account number and a statement personally signed by you that you reject the change. Rejecting a change means you agree to arbitrate under this version of the arbitration provision; it does not remove arbitration altogether.

Qualifications & exceptions

  • Only by U.S. Mail, within 30 days of the first notice of the change.
  • Changes to the Notice Address cannot be rejected.
  • Rejection keeps this version of the arbitration provision in force; it is not an opt-out of arbitration.

AT&T's total liability is capped at a credit or refund of up to 24 months of charges for the affected service

To the greatest extent permitted by law, AT&T's total liability to you under any legal theory is a credit or refund no larger than the total charges you paid for the affected AT&T Service during the shorter of the preceding 24 months or the period in which you experienced the problem. For disputed charges, Section 1.10 separately requires you to contact customer service or send a Notice of Dispute within 180 days of the bill date, except in states that prohibit that notice requirement.

Supporting quotations

To the greatest extent permitted by law, our total liability to you (under any legal theory) is a credit or refund that must not exceed the total amount of charges you paid us for the applicable AT&T Service during the shorter of (i) the preceding 24-month period or (ii) the period in which you experienced the issue giving rise to your claims.
If you are disputing a charge on your bill, Section 1.10 requires you either to notify customer service or submit a Notice of Dispute within 180 days of the bill date.
This limitations period does not apply in any state in which this contractual notice provision is prohibited.

Qualifications & exceptions

  • The cap is measured by charges for the applicable service, over the shorter of 24 months or the problem period.
  • The 180-day billing-dispute deadline does not apply where state law prohibits it.

One neutral arbitrator, a convenient location, and a hearing choice for claims of $10,000 or less

Unless you and AT&T agree otherwise, a single neutral arbitrator is chosen by a strike-and-rank process, and hearings take place somewhere reasonably convenient to you. For claims valued at $10,000 or less you may choose a documents-only arbitration or a telephone, video or in-person hearing; above $10,000 the JAMS Rules decide the right to a hearing. A hearing is required when either side seeks injunctive relief unless agreed otherwise. Settlement offer amounts may not be shown to the arbitrator until relief is decided. The arbitrator must issue a reasoned written decision and, except for the individual-relief limits in 1.3.2.6, can award the same damages and relief a court could.

AT&T pays arbitration fees for its own cases and for your claims of $75,000 or less if you followed the informal process

Beat AT&T's last settlement offer and you get at least $10,000 plus double attorney fees

If you fully complied with the informal dispute process and the arbitrator awards you more on the merits (not counting attorneys' fees, costs and expenses) than AT&T's last written settlement offer made before the record closed, AT&T will pay you the award or $10,000, whichever is greater (the Alternative Payment), and pay your attorney, if any, twice the reasonable attorneys' fees plus reasonable expenses including expert fees (the Attorney Premium).
