User Content, Outputs and associated information posted or shared through Calm may be visible to others. You warrant that your User Content and Calm’s permitted use will not violate rights or injure a person or entity.

When you post or otherwise share User Content or Outputs on or through the Services, you understand that your User Content and Outputs and any associated information may be visible to others. You represent and warrant that your User Content, and our use of such content as permitted by these Terms, will not violate any rights of or cause injury to any person or entity.

Referrals require the recipient’s consent
Referral, sharing and connection messages require that you personally know the recipient, have consent, provide accurate contact details belonging to them and comply with applicable communications laws. No unsolicited, bulk, nonconsensual or opted-out messages are allowed. You are responsible, may be identified as sender, and agree to indemnify Calm for claims from misuse, subject to non-excludable legal rights. Calm may limit, suspend or end referral-feature access at its discretion.

Referrals and Invitations. Certain features of the Services allow you to send messages to others, such as invitations to “refer a friend,” share content, or connect (for example, by email, SMS, or a shareable link). By using these features, you represent and warrant that: (a) you personally know the recipient and have their consent to send them the message; (b) the contact information you submit is accurate and belongs to that recipient; and (c) your use of the feature complies with all applicable laws, including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and any similar anti-spam, telemarketing, or electronic-communications laws. You agree not to send referral or invitation messages that are unsolicited, sent in bulk, or directed to anyone who has not consented or who has opted out of receipt of such messages. You are solely responsible for these messages, which may identify you as the sender, and you agree to indemnify and hold Calm harmless from any claims arising out of your misuse of these features. We reserve the right to limit, suspend, or terminate access to referral features at our discretion.
If you are located in a country which provides consumer guarantees or imposes obligations on us which cannot be excluded, restricted, or modified, or only to a limited extent, then nothing in these Terms is intended to exclude, restrict, or modify such mandatory guarantees or obligations. For instance, if you are in Australia, these Terms are subject to the Australian Consumer Law, as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
