Federal law only lets you limit three kinds of sharing; state law may add more

Federal law gives you the right to limit only sharing of your creditworthiness for affiliates' everyday business purposes, affiliates using your information to market to you, and sharing for nonaffiliates to market to you. Venmo says it does not do any of these three. State laws and individual companies may give you additional rights to limit sharing; the notice points to state-law information below it.

California privacy-law rights do not reach data handled under federal financial privacy law

In the consumer notice's California paragraph, Venmo says the California Consumer Privacy Act lets California residents ask covered businesses what personal information they have collected, request access or deletion, and opt out of the "sale" or "sharing" of personal information, if applicable. It then says these provisions do not apply to personal information that financial institutions collect, process, share or disclose under federal law such as the Gramm-Leach-Bliley Act. Elsewhere Venmo states it does not sell or share personal information in the California sense, so the opt-out has nothing to act on. If your Venmo account has a California mailing address, Venmo will not share personal information it collects about you except as California law permits. You can contact Venmo with questions about the statement, this notice or your information.

Supporting quotations

California:
The California Consumer Privacy Act (CCPA) permits consumers who are California residents to ask businesses covered under the CCPA about personal information it has collected about the consumer, submit an access or deletion request, and opt-out of the “sale” or “sharing” of personal information, if applicable.
These provisions do not apply to personal information collected, processed, shared, or disclosed by financial institutions pursuant to federal law such as the Gramm-Leach-Bliley Act.
If your Venmo account has a California mailing address, we will not share personal information we collect about you except to the extent permitted under California law.
Contact us if you have questions about our privacy statement, this consumer notice, or your personal information.
We do not sell or share your Personal Information, including any Sensitive Personal Information.

Not stated here

  • Which of Venmo's data falls under the federal-law exception, and so outside the California access and deletion rights, is not identified.
  • The notice does not say how to submit a California access or deletion request.
  • The Gramm-Leach-Bliley Act and California law are named but not supplied; their content is not analyzed.
