These Terms of Sale govern purchases of WHOOP products from WHOOP's online store or from an authorized third-party retailer or marketplace. 'Products' means the WHOOP device, bands, chargers and PowerPacks, plus peripherals, accessories, apparel and other products offered by WHOOP or a WHOOP authorized partner. Buying a WHOOP membership or Advanced Labs services is not covered here and is governed by WHOOP's Terms of Use instead.
THESE TERMS OF SALE SET FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR PURCHASE OF THE WHOOP DEVICE, BANDS, CHARGERS AND POWERPACKS (COLLECTIVELY, THE ‘WHOOP DEVICE,” EVEN IF SUCH PURCHASE IS PART OF A WHOOP MEMBERSHIP PURCHASE), AND ANY PERIPHERALS, ACCESSORIES, APPAREL, OR OTHER PRODUCTS OFFERED BY WHOOP OR A WHOOP AUTHORIZED PARTNER (AS DEFINED BELOW), THAT ARE AVAILABLE FOR PURCHASE FROM OUR ONLINE STORE (THE “STORE”) OR THROUGH AN AUTHORIZED THIRD-PARTY RETAILER OR AUTHORIZED THIRD-PARTY MARKETPLACE (EACH, AN “AUTHORIZED RESELLER”)
PRODUCTS AND WHOOP PRODUCTS SHALL NOT INCLUDE THE PURCHASE OF WHOOP MEMBERSHIPS AND ADVANCED LABS SERVICES, WHICH SHALL BE GOVERNED UNDER OUR TERMS OF USE.
THESE TERMS OF SALE COVER IMPORTANT INFORMATION ABOUT THE PRODUCTS YOU PURCHASE AND ANY CHARGES AND AMOUNTS THAT WE BILL YOU.

By placing an order for a product, you acknowledge that you have read and understood these Terms of Sale and agree to be bound by them. If you do not accept them, you are not authorized to purchase products. Wherever the terms use 'including' or a similar expression, the examples that follow are illustrative and do not narrow the general wording before them.
THIS IS A LEGAL AGREEMENT. BY PLACING AN ORDER FOR A PRODUCT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SALE.
If you do not accept these Terms of Sale, then you are not authorized to purchase Products. WHOOP may collaborate with certain brands, called WHOOP Authorized Partners, so that certain WHOOP products can be integrated into products the partners offer. WHOOP says it will identify the partners, and their associated products, in the store.

WHOOP says it makes reasonable efforts to show product attributes accurately, but it cannot guarantee that your screen displays colors accurately.
To the extent permitted under applicable laws, we make no representations, warranties, or conditions as to the completeness, accuracy, reliability, validity or timeliness of any listings, content, descriptions or images (including, without limitation, any features and specifications such as weights and sizes) for any Products available through the Store or via an Authorized Reseller.
We make reasonable efforts to accurately display the attributes of Products, including the applicable colors, however the actual colors you see on the Store will depend on your computer system, and we cannot guarantee that your computer will accurately display such colors.

Products sold through the Store or via an Authorized Reseller and by WHOOP Authorized Partners are the only items compatible with the Products, including but not limited to the WHOOP Device.

BE LIABLE FOR ANY INDIRECT DAMAGES (INCLUDING, WITHOUT LIMITATION, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION), EVEN IF WHOOP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

To the extent applicable laws allow, the total amount the WHOOP Parties can owe you is capped at the greatest of three figures: the amount you paid for the particular product, $100, or the remedy or penalty imposed by the statute or regulation under which your claim arises. The terms describe these damage limits as fundamental elements of the basis of the bargain between you and WHOOP or the authorized reseller.
(B) IN NO EVENT SHALL THE AGGREGATE AMOUNT THAT THE WHOOP PARTIES ARE LIABLE TO YOU EXCEED THE GREATER OF (I) THE AMOUNT PAID FOR A PARTICULAR PRODUCT, (II) $100, OR (III) THE REMEDY OR PENALTY IMPOSED BY THE STATUTE OR REGULATION UNDER WHICH SUCH CLAIM ARISES
THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN WHOOP OR AUTHORIZED RESELLER AND YOU.

WHOOP may send notifications, whether required by law or for marketing or other purposes, by email (at its option) to the email address associated with your order. WHOOP is not responsible for automatic filtering you or your network provider applies, and recommends adding @whoop.com addresses to your address book. For email notifications, the date the message is sent is treated as the date of notification.
NOTIFICATIONS
WHOOP may provide notifications to you as required by law or for marketing or other purposes via (at its option) email to the email associated with your order.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by an act or event beyond our reasonable control, including without limitation acts of God, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, terrorist attack, war, fire, explosion, storm, flood, earthquake, epidemic or other natural disaster, failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
