Most disputes go to informal resolution, small claims or individual arbitration

The Agreement requires you and AT&T to resolve most disputes through an informal process, in small claims court, or through arbitration on an individual basis rather than through jury trials or class actions. Arbitration is described as a less formal alternative to a lawsuit in which a neutral arbitrator decides the dispute, applies the same law, can award the same individualized remedies a court could, uses streamlined procedures and discovery, and issues a legally binding decision subject to limited court review.

What it does
Resolve disputes informally, in small claims court, or by individual arbitration

Supporting quotations

It requires you and AT&T to resolve most disputes through an informal process, in small claims court, or through arbitration on an individual basis rather than jury trials or class actions.
The informal dispute resolution process gives you the opportunity to explain what happened to someone in, or working with, our legal department.
The arbitrator’s decision is legally binding, and it is subject to limited review by courts.

Qualifications & exceptions

  • Applies to "most" disputes; later subsections set exceptions such as small claims and bodily injury.

Legal Rights & Agreement Rules · Restriction or exception

You and AT&T agree to arbitrate all disputes, except bodily injury or death

To the greatest extent permitted under the Federal Arbitration Act, you and AT&T agree to arbitrate all disputes and claims between you and AT&T, except claims arising from bodily injury or death. The scope is meant to be read broadly and includes claims in contract, tort, fraud, misrepresentation or any statutory or common-law theory; claims that arose before this or any prior Agreement (including advertising claims); claims for mental or emotional distress not arising out of bodily injury; claims that are currently the subject of purported class action litigation in which you are not a member of a certified class; and claims that arise after the Agreement ends.

Either side may use small claims court instead of arbitration

Despite the arbitration provision, you or AT&T may bring a dispute, or elect to have it heard, in the small claims court for the county (or parish) of your billing address. Such disputes are not subject to arbitration only while they remain in that court and advance only individual (non-class, non-representative) claims seeking individualized relief. The small claims court first decides whether the dispute is within its jurisdictional limits; otherwise a court of competent jurisdiction decides. A small claims proceeding also cannot begin until the informal resolution period has ended.

Federal Arbitration Act governs; provision survives termination

The Agreement states that it evidences a transaction in interstate commerce, so the substantive and procedural provisions of the Federal Arbitration Act, not state arbitration law, govern interpretation and enforcement of the arbitration provision. The arbitration provision survives termination of the Agreement. The provision also does not stop you from bringing issues to federal, state or local agencies such as the FCC, which can, if the law allows, seek relief against AT&T on your behalf.

A written Notice of Dispute is the first step

If customer service cannot resolve a concern, the first step is a written Notice of Dispute. AT&T will likewise send you a Notice at your billing address if it has a dispute with you. A Notice to AT&T may be sent by U.S. mail or professional courier to the Legal Department Notice Address in Dallas, Texas, or submitted electronically. It must include everything the Notice form asks for, including claimant name, address and phone, the Account number, the services involved, the nature and basis of the claim, and the specific relief sought with the basis for calculations. It must be personally signed by you (or by an AT&T representative if AT&T is the claimant). Before AT&T discusses or shares Account information with anyone other than you, including an attorney, you must provide authentication and consent.

Both sides must cooperate in good faith to schedule it, it may occur after the 60 days, you and an AT&T representative must personally participate unless otherwise agreed in writing, and lawyers may also participate. Legal Rights & Agreement Rules · Restriction or exception

Arbitration or small claims cannot start until informal process ends

Any arbitration or small claims court proceeding cannot begin until the Informal Resolution Period has ended; subsection 1.3.2.7 adds requirements for mass arbitrations. These informal requirements are called essential. If they have not been met, a court of competent jurisdiction can enjoin the filing or prosecution of an arbitration or small claims proceeding; unless the law prohibits it, JAMS may not accept, administer, assess or demand fees for that arbitration; and a pending arbitration must be dismissed. Both parties keep the right to seek relief for non-compliance with this condition in arbitration.

How the arbitrator is chosen, hearings, written decision and relief

Unless you and AT&T agree otherwise, a single neutral arbitrator is chosen through a strike-and-rank process (the same way a Process Administrator is chosen, if one is requested), and hearings take place at a location reasonably convenient to you. If your claim is valued at $10,000 or less, you choose whether the arbitration is decided on documents only or through a telephonic, videoconference or in-person hearing under the JAMS Rules; above $10,000 the JAMS Rules decide the right to a hearing. Unless you and AT&T agree otherwise, a hearing is required if either side seeks injunctive relief. Settlement offer amounts must not be disclosed to the arbitrator until the arbitrator decides what relief, if any, is due. The arbitrator must issue a reasoned written decision. The arbitrator can award the same damages and relief a court can under applicable law, except that under subsection 1.3.2.6 relief may be awarded only in favor of the individual party and only as needed for that party's individual claim, and the arbitrator cannot consolidate more than one person's claims or preside over class, collective, representative, private attorney general or public injunction proceedings unless both sides agree otherwise.

the arbitrator cannot consolidate more than one person’s or entity’s claims, and cannot preside over any form of class, collective, representative, private attorney general, or public injunction proceeding.

If a court finally decides, after all appeals, that any of these bans is unenforceable, all other aspects of the case must be arbitrated first and a court then decides the remaining parts that cannot be arbitrated. Mass arbitrations proceed in stages of 40 cases with mediation

In the first stage, claimants' counsel and AT&T each select 20 cases (40 total) to be filed and resolved individually by different arbitrators, from the claimants' home states if feasible; if there are fewer than 40, all are filed. Meanwhile no other cases are deemed filed or proceed in arbitration, and JAMS must not assess fees for, administer or accept the remaining cases. Arbitrators are encouraged to resolve the cases within 120 days of appointment. After the first stage the parties must hold a single mediation of all remaining cases, and AT&T pays the mediation fee. Mass arbitration: tolling, meet-and-confer, court enforcement and fallback to court

Between stages, counsel meet and confer about improving efficiency, including whether to file more cases per stage and whether to raise administrative issues with a JAMS Process Administrator, and either party may talk to JAMS about fees. If your dispute is part of a Mass Arbitration, limitations periods are tolled from when it is first submitted to JAMS until it is picked to proceed, settled, withdrawn, otherwise resolved or opted out. A court can enforce this subsection, including by enjoining the mass filing, the prosecution or administration of arbitrations, or JAMS fee assessment or collection. AT&T Phone 911 differs from landline 911; it fails in outages and you indemnify AT&T

AT&T Phone, provided via voice over IP, is not the same as traditional wireline service and 911 does not work the same way; you agree to tell anyone who may use the service of these limitations. AT&T makes no warranty that access to 911 will be uninterrupted, timely, secure or error-free. 911 is available only at your service address, while connected to a properly powered and configured iNID or Wi-Fi Gateway (and ONT, if applicable) and after the service has been properly activated. It will not function if the service is not functioning or in a power or network outage, broadband connection failure, or if service is disconnected or suspended, and after an outage you may need to reset or reconfigure your Equipment. "Speed" is a capability range measured only on the Connection segment

Each AT&T internet access option has a specific service capability speed range, and "speed" is shorthand for capacity measured in kilobits, megabits or gigabits per second. Expected Speed is a theoretical, anticipated figure; wireless services may have none

Many factors beyond the Connection affect the speed you experience

End-to-end performance depends on many factors, including but not limited to the number of subscribers using the network at once; your location and your destination's characteristics; overall internet traffic; Wi-Fi connectivity; interference on your telephone line; wiring inside your premises; the capacity of your routers, gateways and modems; the servers you must reach; internal and external network management factors including overhead; and the networks you and others use. Actual Wi-Fi speeds are well below theoretical maximums and capped by your Internet speed

Home or Local Wi-Fi is designed to provide the highest speed available from your home network at any point in time, subject to many factors. AT&T's most recent Wi-Fi Equipment generally supports Wi-Fi 6 and older standards, though older equipment may support only older standards, and your theoretical maximum depends on both the equipment's and your device's standard (for example an older device limited to the Wi-Fi 1 standard caps you at 11 Mbps even with Wi-Fi 6 equipment). Actual Wi-Fi speeds are substantially lower than theoretical maximums; the maximum you can receive may not exceed 40%-50% of the theoretical maximum and may be significantly lower. The speed you experience also depends on the connection between the Wi-Fi network and the destination, so for an example 100 Mbps plan the theoretical maximum download over Wi-Fi would not be expected to exceed 100 Mbps.

Details
What it covers
Home Wi-Fi speeds

Supporting quotations

The theoretical maximum speed you may be capable of achieving from your Home Wi-Fi will depend heavily on which Wi-Fi (IEEE 802.11) standard is supported by the Wi-Fi Equipment you have as well as which Wi-Fi (IEEE 802.11) standard is supported by the particular device you are utilizing.
actual Wi-Fi speeds will be substantially lower than the theoretical maximum speeds which describe the physical throughput rate including Wi-Fi protocol communications. The result is that the maximum you can receive may not exceed 40%-50% of the theoretical maximum Wi-Fi standard speed and may be significantly lower depending on other applicable factors.
the actual speed you experience over Wi-Fi will depend in part on the speed of the connection between the Wi-Fi network you are accessing and the destination you want to reach on the Internet

Internet power and battery backup are your responsibility; power loss disrupts VoIP and e911

AT&T Equipment may require electrical power from your premises, which you must provide. If there is a gateway at your premises AT&T will not provide an initial gateway battery backup unit or backup battery; any backup battery solution is your responsibility, and you may buy battery backup from third parties. You are solely responsible for determining when backup batteries need replacement and for replacing and recycling them following manufacturer directions. AT&T Equipment without battery backup will not function when customer-supplied power is lost, which will disrupt your Internet Service and other services that use the AT&T Connection for transport or need an internet connection to work, such as Voice over IP including e911. AT&T has no liability for loss of any service, whether provisioned by AT&T or a third party, when customer-supplied power is interrupted, with or without battery backup in the AT&T equipment.
