Most disputes go to individual arbitration, with class action and jury trial waivers
By accepting the agreement you agree to resolve most disputes by arbitration on an individual basis, and you waive class actions and jury trials. The agreement itself notes that arbitration has less discovery and appellate review than court. The arbitration section carves out exceptions: either side may take an individual Dispute to small claims court, and disputes over copyrights, trademarks, patents or trade secrets are not subject to arbitration. You can opt out of arbitration by mailing a written notice postmarked within 30 days after you first accept the agreement; the class action and jury trial waivers still apply if you opt out.

The terms include an agreement to resolve most disputes by arbitration on an individual basis, a class action waiver, and a jury trial waiver.
In arbitration, there is less discovery and appellate review than in court.

Disputes arising from the violation or threatened violation of copyrights, trademarks, patents, or trade secrets will not be subject to arbitration

If you opt out of arbitration, all other parts of the user agreement (including the other provisions of the Dispute Resolution section, such as the class action waiver and jury trial waiver) will continue to apply.
Qualifications & exceptions
Small claims court remains available for individual Disputes that are not removed or appealed to a court of general jurisdiction.
Intellectual-property disputes (copyrights, trademarks, patents, trade secrets) are excluded from arbitration.
Opt-out is only by mailed, signed notice postmarked no later than 30 days after first acceptance; opting out leaves the class action and jury trial waivers in place.

Nearly all disputes go to binding arbitration, except individual small claims and IP disputes
You and PayPal agree that any dispute about the agreement, Venmo, your account (including linked Teen Accounts) or your relationship with PayPal, on any legal theory, is resolved by final and binding arbitration. Either side may instead use small claims court if the case stays individual and is not removed or appealed to a court of general jurisdiction. Disputes about violations of copyrights, trademarks, patents or trade secrets are excluded from both arbitration and the informal resolution process. "Dispute" is read broadly under the Federal Arbitration Act and includes disputes arising before this or any prior agreement and after termination.

Courts decide whether the arbitration terms are valid and which agreement version applies; federal law governs
The arbitrator decides all issues except those reserved for a court: issues the agreement reserves for courts; the scope, validity and enforceability of the Arbitration Agreement, class and jury waivers or any dispute provision; arbitrability; and which version of the agreement applies. Whether a case fits small claims limits is for the small claims court first. The Arbitration Agreement is governed by the Federal Arbitration Act and federal arbitration law, not state arbitration law.

A valid Notice of Dispute needs your handwritten signature, claim details and a relief calculation
Send the Notice of Dispute to PayPal, Attn: Legal Specialists, at its Omaha P.O. box; PayPal sends notices to the address on file, which you must keep current. To be valid it must include everything the form requires, including your original handwritten signature (and your lawyer's, if represented), your account email and phone, a detailed description of the claims, the specific relief sought with a good-faith calculation, and relevant documents reasonably available. If a lawyer submits it, you must also give signed written authorization for PayPal to discuss your account and share records with the lawyer, and PayPal may ask you to verify your identity and authorization.

60 days of good-faith negotiation must happen before arbitration; deadlines pause meanwhile
For 60 days after a complete Notice of Dispute is received, both sides must negotiate in good faith. The recipient may request a phone or video settlement conference, which you and a PayPal representative must personally attend (with counsel if represented), possibly scheduled after the 60 days. Completing this Process is a condition precedent to arbitration. Disputes over the notice's sufficiency or compliance may go to court, which can stop the arbitration and fee collection, and the arbitration is stayed meanwhile. Limitations periods are tolled from receipt of the notice until the Process ends or the claim is withdrawn.

If the sufficiency of a Notice of Dispute or compliance with this Process is at issue, such issue may be decided by a court of competent jurisdiction, and any arbitration shall be stayed.

One arbitrator, decided on written submissions unless a hearing is warranted, near where you live
The parties choose a single neutral arbitrator by strike-and-rank. Arbitration proceeds on written submissions only unless a party asks for an in-person, phone or video hearing and the arbitrator finds one warranted. An in-person hearing is held within 50 miles of your county or parish of residence or another agreed place, and you and a PayPal representative must personally appear.

Legal Rights & Agreement Rules · Restriction or exception
Arbitrators can grant only individual relief; no class, collective or representative proceedings
The arbitrator may award any relief a court could, but injunctive or declaratory relief only for the individual claimant and only as needed for that person's claim. Each side may bring claims only individually, not as a plaintiff or class member in any class, collective, consolidated, private attorney general or representative proceeding, and unless both agree the arbitrator cannot consolidate claims. If, after all appeals, these limits are held unenforceable for a particular claim or request (such as public injunctive relief), that claim goes to court after the other claims are arbitrated.

Both sides may file dispositive motions before any hearing. The arbitrator must enforce the agreement as a court would, apply applicable law and equity, and honor legal privileges. Any information exchange must be proportional to the case, considering amount and burden. Mass arbitration (25+ coordinated claims) proceeds in stages and may be delayed or end up in court
If 25 or more similar coordinated disputes (including yours) are brought against PayPal, extra Mass Arbitration procedures apply, and your dispute may be delayed and ultimately proceed in court. Counsel must confer in good faith. Limitations periods are tolled from submission to JAMS until your dispute is selected, resolved, withdrawn or opted out. In Stage One, if there are 50 or more disputes, each side picks 25 to be arbitrated individually; others cannot proceed and JAMS charges no fees for them meanwhile; arbitrators are encouraged to finish within 120 days. A global mediation follows, with PayPal paying the mediator; if that fails, Stage Two repeats the selection of 50 cases and another PayPal-paid mediation.

In the meantime, no other Disputes may be filed or proceed in arbitration as cases, and JAMS will not assess or demand payment of fees for the remaining Disputes or cases, nor will JAMS administer them.
After Stage One is completed, counsel for the parties shall engage in a global mediation and attempt to resolve all remaining Disputes, and PayPal will pay the mediator’s fee
