The packet opens with a notice that the Terms of Use affect the user's legal rights and obligations, specifically naming waivers of rights, limitation of liability, and the user's indemnity to CNN, and stating that the agreement requires arbitration on an individual basis to resolve disputes rather than courts or jury trials while limiting available remedies. Section 13(9) later qualifies individual arbitration with a staged mass-filing process when 25 or more coordinated claimants submit notice or demands; the intro notice itself does not mention that exception, so this card records the notice as written and the mass-filing layer as a later material qualifier.

THIS AGREEMENT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN COURTS OR JURY TRIALS, AND LIMITS THE REMEDIES AVAILABLE IN THE EVENT OF A DISPUTE.
If, at any time, 25 or more claimants (including you) submit Notices or seek to file demands for arbitration raising similar claims against the other party or related parties by the same or coordinated counsel or entities
Qualifications & exceptions

No liability for loss/damage; aggregate cap: 6 months paid or $100
The 'CNN Parties' (the protected group defined in 7(B)) state they do not accept liability for loss or damage of any listed kind — direct, indirect, punitive, actual, consequential, incidental, special, exemplary or otherwise — arising from the user's use of, or inability to use, the Service. CNN's aggregate liability connected to the Service or the Terms may not exceed the greater of what the user paid to CNN in the six months immediately before the event giving rise to the claim, or $100. The exclusions and limitations apply to all action types — breach of contract, tortious behavior, negligence, or any other cause of action — even if the CNN Parties were advised of the possibility of such loss. Where applicable law does not allow the limitation to apply (or to apply in full), it applies only to the extent the law permits. THE CNN PARITES DO NOT ACCEPT ANY LIABILITY FOR ANY LOSS OR DAMAGE (DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR OTHERWISE) ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

IF APPLICABLE LAW DOES NOT ALLOW ALL OR ANY PART OF THE ABOVE LIMITATION OF LIABILITY TO APPLY TO YOU, THE LIMITATIONS WILL APPLY TO YOU ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
Except as specified in Section 13 (Dispute Resolution), if any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable for these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
Qualifications & exceptions
The cap is an aggregate total across claims tied to the Service or the Terms, not per-claim.
The applicable-law savings clause adjusts the limit to what the law permits rather than voiding it.
Subject to Section 13 (Dispute Resolution) and only to the extent applicable law permits, any dispute, claim or controversy about the CNN Services or the Terms must be commenced within one year of the relevant events. Filing in arbitration — or, for non-arbitrable disputes, in a court with jurisdiction — counts as commencement if done within the year. A Notice of Dispute under Section 13(2) tolls the year for 60 days after receipt, and a mass filing per Section 13(9) may extend it further. Each party waives, and permanently loses in any forum, the right to any dispute not fileed within one year. For non-arbitrable disputes, the later venue section names the appropriate state or federal court in New York County, New York, with exclusive jurisdiction and venue for non-arbitral claims.

IF YOU OR CNN PROVIDE NOTICE OF A DISPUTE UNDER SECTION 13(2), THE ONE-YEAR PERIOD IS TOLLED FOR 60 DAYS FOLLOWING RECEIPT OF THE NOTICE OF DISPUTE (ALTHOUGH FOR THE SAKE OF CLARITY IT MAY BE FURTHER EXTENDED IF YOUR DISPUTE, CLAIM, OR CONTROVERSY IS PART OF A MASS FILING AS CONTEMPLATED IN SECTION 13(9)).
YOU AND CNN EACH WAIVE—THAT IS, GIVE UP—THE RIGHT TO PURSUE ANY DISPUTE, CLAIM OR CONTROVERSY THAT IS NOT FILED WITHIN ONE YEAR AND ANY RIGHT YOU OR CNN MAY HAVE HAD TO PURSUE THAT DISPUTE, CLAIM OR CONTROVERSY IN ANY FORUM IS PERMANENTLY BARRED.
Any dispute that is not subject to arbitration under Section 13 (Dispute Resolution) of these Terms of Use, or any issues involving arbitrability or enforcement of provisions under Section 13, shall be brought in the appropriate state or federal court located in New York County, New York; and we both irrevocably consent to the exclusive jurisdiction and venue of the state or federal courts in New York County, New York for the adjudication of all non-arbitral claims.
Qualifications & exceptions
The rule is expressly 'SUBJECT TO SECTION 13 (DISPUTE RESOLUTION)' and limited to what applicable law permits.
Tolling: 60 days after notice receipt; mass-filing cases may extend it further (Section 13(9)).
The waiver and permanent bar apply to both sides equally.

New York law governs; non-arbitrable claims in New York County courts
Any disputes, claims or controversies arising out of or in connection with access to or use of the CNN Services, or the provision of Content, services or technology on or through it, are governed exclusively by the laws of the State of New York as applied to contracts made and performed entirely within it, without its conflict-of-laws rules, except to the extent that law is inconsistent with or preempted by federal law. Binding arbitration or small claims court replaces general-jurisdiction courts
If the user is not satisfied with customer service's solution, and the Informal Dispute Resolution Procedures below have not resolved the dispute, both the user and CNN agree to resolve the dispute through binding arbitration or small claims court instead of courts of general jurisdiction.
In the unlikely event that you’re not satisfied with customer service’s solution, and you and CNN are unable to resolve a dispute through the Informal Dispute Resolution Procedures below, we each agree to resolve the dispute through binding arbitration or small claims court instead of in courts of general jurisdiction.
Qualifications & exceptions
Small claims court remains available as an alternative to arbitration.
The Terms characterize arbitration as more informal than a lawsuit: a neutral arbitrator replaces judge and jury, discovery is more limited, and court review is very limited. Unless the arbitration provision limits the power, the arbitrator can award the same damages and relief a court could. Arbitration proceeds on an individual basis — class arbitrations and class actions are not permitted — and a user may recover attorneys' fees from CNN to the same extent as in court.

Supporting quotations
Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. Unless expressly limited by this arbitration provision, arbitrators can award the same damages and relief that a court can award.
Any arbitration under these Terms of Use will take place on an individual basis; class arbitrations and class actions are not permitted.
In arbitration you may be entitled to recover attorneys’ fees from us to the same extent as you would be in court.
Qualifications & exceptions
The equal-remedies point is qualified: 'unless expressly limited by this arbitration provision'.
Fee recoverability is parity-based: same extent as in court.

All claims arbitrate except bodily-injury and IP-validity claims; scope examples
To the fullest extent permitted by applicable law, CNN and the user agree to arbitrate all disputes and claims between them, with the Arbitration Agreement 'intended to be broadly interpreted', except for claims arising from bodily injury and claims about enforcing, protecting or the validity of IP rights of either party (or their licensors, affiliates and partners). Included claims are, among others: contract, tort, fraud, misrepresentation, or any statutory or common-law claim; claims predating this Agreement (including advertising-related claims); claims for mental or emotional distress or injury not arising from physical bodily injury; claims currently the subject of purported class-action litigation where the claimant is not a certified-class member; and claims arising after the Terms' termination.

ARBITRATION AGREEMENT
(1) Claims Subject to Arbitration: To the fullest extent permitted by applicable law, CNN and you agree to arbitrate all disputes and claims between us, except for claims arising from bodily injury or that pertain to enforcing, protecting, or the validity of your or our intellectual property rights (or the intellectual property rights of any of our licensors, affiliates and partners). This Arbitration Agreement is intended to be broadly interpreted.
claims arising out of or relating to any aspect of the relationship between us, whether based in contract, tort, fraud, misrepresentation or any other statutory or common-law legal theory;
claims that arose before this or any prior Agreement (including, but not limited to, claims relating to advertising);
claims for mental or emotional distress or injury not arising out of physical bodily injury;
claims that are currently the subject of purported class action litigation in which you are not a member of a certified class; and
claims that may arise after the termination of these Terms of Use.
This is not an opt out of arbitration altogether.
Qualifications & exceptions
The two carve-outs are bodily-injury claims and IP-related enforcement/validity claims.
Pre-agreement and post-termination claims both fall inside the arbitration duty.
Not stated here
What 'broadly interpreted' means in application is not further defined in the source.
Who is bound; small-claims election; agency complaints; FAA governs; survives termination
References to 'CNN', 'you', 'we' and 'us' in the Arbitration Agreement include predecessors, successors and assigns, past, present and future parents, subsidiaries and affiliates — expressly including Warner Bros. Discovery, Inc. and its affiliates — plus agents, employees, licensees, licensors and content providers at the time the claim arises, and authorized or unauthorized users or beneficiaries of the CNN Services under this or prior Agreements. Either party may still elect small-claims court for individualized relief, provided the action is not removed or appealed to a court of general jurisdiction. Nothing prevents the user from bringing issues to federal, state or local agencies. Entering the Terms means each side waives class-action participation and jury trial to the fullest extent permitted. The Federal Arbitration Act (9 U.S.C. §§ 1-16 — external citation, classified by citation without resolving its text) governs the provision's interpretation and enforcement, and the Arbitration Agreement survives termination of the Terms.

This Arbitration Agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies.
You agree that, by entering into these Terms of Use, you and we are each waiving the right to participate in a class action and to a trial by jury to the fullest extent permitted by applicable law.
This Agreement evidences a transaction in interstate commerce, and thus the Federal Arbitration Act (9 U.S.C. §§ 1-16) governs the interpretation and enforcement of this arbitration provision.
Qualifications & exceptions

Notice compliance is a condition precedent: tolling, injunction, administrator-fee bar, administrative closure
Compliance with the Mandatory Pre-Arbitration Notice and Informal Dispute Resolution Procedures is a condition precedent to initiating arbitration. Applicable limitations periods (including statutes of limitations) and filing-fee deadlines are tolled while the parties engage in the §13(2) procedures. If any aspect of the requirements has not been met, a court of competent jurisdiction may enjoin the filing or prosecution of an arbitration. Unless prohibited by law, the arbitration administrator may not accept, administer, assess or demand fees in connection with an arbitration initiated without completing the Procedures, and an already-pending such arbitration must be administratively closed. Nothing in the paragraph limits a party's right to seek damages for non-compliance with the Procedures in arbitration. The Procedures are 'essential' so that the user and CNN have a meaningful opportunity to resolve disputes informally.

Compliance with this Mandatory Pre-Arbitration Notice and Informal Dispute Resolution Procedures section is a condition precedent to initiating arbitration. Any applicable limitations period (including statute of limitations) and any filing fee deadlines shall be tolled while the parties engage in the informal dispute resolution procedures set forth in this Subsection 13(2). All of the Mandatory Pre-Arbitration Notice and Informal Dispute Resolution Procedures are essential so that you and CNN have a meaningful opportunity to resolve disputes informally. If any aspect of these requirements has not been met, a court of competent jurisdiction may enjoin the filing or prosecution of an arbitration. In addition, unless prohibited by law, the arbitration administrator may not accept, administer, assess, or demand fees in connection with an arbitration that has been initiated without completion of the Mandatory Pre-Arbitration Notice and Informal Dispute Resolution Procedures. If the arbitration is already pending, it shall be administratively closed. Nothing in this paragraph limits the right of a party to seek damages for non-compliance with these Procedures in arbitration.
(9) Mass Filing: If, at any time, 25 or more claimants (including you) submit Notices or seek to file demands for arbitration raising similar claims against the other party or related parties by the same or coordinated counsel or entities, consistent with the definition and criteria of Mass Filings
Qualifications & exceptions
Tolling applies during engagement in the informal procedures.
The fee bar is subject to 'unless prohibited by law'.
An arbitration initiated without compliance is administratively closed if already pending, not merely refused.
In a Mass Filing (25+ similar claimants), additional procedures apply and tolling likewise begins when the §13(2) procedures are initiated — provided the Notice complies with Section 13.2 — running until the claim is selected for the staged process, settled, withdrawn, resolved or opted out.
Not stated here
Consequences of non-compliance beyond injunction, fee bar, administrative closure and damages claims are not further specified.

The amount or terms of any settlement offer may not be disclosed to the arbitrator until after the arbitrator issues an award on the claim. If the award is issued in the other party’s favor and is less than the defending party’s settlement offer or if the award is in the defending party’s favor, the other party must pay the defending party’s costs incurred after the offer was made, including any attorney’s fees. If any applicable statute or case law prohibits the shifting of costs incurred in the arbitration, then the offer in this provision shall serve to cease the accumulation of any costs to which the party bringing the claim may be entitled for the cause of action under which it is suing.
Qualifications & exceptions
The offer is optional for the defending party.
Cost-shifting triggers on rejecting an offer that equals or exceeds the eventual award in the offeror's disfavor scenarios defined above.
Where law forbids cost-shifting, the offer still cuts off further cost accumulation for that cause of action.
Legal Rights & Agreement Rules · Restriction or exception
For non-individualized outcomes, the arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. To the fullest extent permitted by applicable law, each party may bring claims against the other only in its individual capacity — not as a plaintiff or class member in any purported class, representative, or private attorney general proceeding. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any representative, class, or private attorney general proceeding. If any of those prohibitions is found unenforceable (after exhaustion of all appeals) as to a particular claim or request for relief, that claim or request is decided by a court of competent jurisdiction after all other arbitrable claims and requests for relief are arbitrated. Any arbitrations between the user and CNN are subject to this Section 13 and not to any prior arbitration agreement; notwithstanding anything to the contrary in the Terms, this Section 13 amends any prior arbitration agreement, including as to claims that arose before this or any prior arbitration agreement.

(7) Requirement of Individualized Relief: The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING.
Further, unless both you and we agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative, class, or private attorney general proceeding.
then the parties agree such a claim or request for relief shall be decided by a court of competent jurisdiction, after all other arbitrable claims and requests for relief are arbitrated.
You agree that any arbitrations between you and CNN will be subject to this Section 13 and not to any prior arbitration agreement you had with CNN, and, notwithstanding any provision in these Terms of Use to the contrary, you agree that this Section 13 amends any prior arbitration agreement you had with CNN, including with respect to claims that arose before this or any prior arbitration agreement.
Notwithstanding the foregoing, you or CNN may participate in a class-wide settlement.
Qualifications & exceptions
The consolidation bar falls only on mutual agreement of both parties.
The unenforceability fallback is claim- or request-specific, not wholesale: all other arbitrable claims proceed in arbitration.
The supersession covers pre-existing claims as well as new ones.

13(8): opt out of future Arbitration Agreement changes via notice@wbd.com within 30 days
Notwithstanding any provision to the contrary, if CNN makes a future change to the Arbitration Agreement — other than a change to the Notice Address — the user may reject the change by emailing notice@wbd.com within 30 days of the posting of the amended arbitration agreement. The email must state: (i) full legal name; (ii) complete mailing address; (iii) phone number; (iv) if applicable, the username or email address associated with any potential account or newsletter; and (v) the approximate date of the user's initial use of the relevant CNN Service. The email must be sent by the user personally — not by an agent, attorney or anyone else purporting to act on the user's behalf — and include a statement, personally signed by the user, that they wish to reject the change. 13(9): Mass Filing procedures for 25+ similar claimants; tolling until staged resolution
If 25 or more claimants (including the user) submit Notices or seek to file arbitration demands raising similar claims against the other party or related parties through the same or coordinated counsel or entities, consistent with the Mass Filings definition and criteria in NAM's Mass Filing Supplemental Dispute Resolution Rules (external linked rules, not supplied in the source), the additional mass-filing procedures apply. Throughout the process the parties' counsel must meet and confer on modifications suited to the Mass Filing's particular needs. Electing to participate in a Mass Filing may delay adjudication. Any applicable limitations period (including statutes of limitations) and filing-fee deadlines are tolled beginning when the Mandatory Pre-Arbitration Notice and Informal Dispute Resolution Procedures are initiated — so long as the pre-arbitration Notice complies with Section 13.2 — until the claim is selected to proceed in the staged process or is settled, withdrawn, otherwise resolved, or opted out of arbitration.

Stage One: 50 claims in individual arbitrations; held claims carry no fees; global mediation after
In a Mass Filing, counsel for the claimants and counsel for CNN each select 25 claims (50 total) to be filed and to proceed in individual arbitrations as part of a staged process. Each is assigned to a different, single arbitrator unless the parties agree otherwise in writing. Remaining claims are not filed or deemed filed in arbitration, and no arbitration fees are assessed for them, unless and until they are selected into a staged process. Post-Stage-3 Option One: either party opts the claim out of arbitration to court
If the claim is not resolved in the staged process, the first option: the user and CNN — separately or by agreement — may opt out of arbitration and elect to have the claim heard in court consistent with the Agreement. The user opts out by sending CNN an individual, personally signed notice of intent by email to notice@wbd.com; it must be sent by the user personally (not an agent, attorney or other purported representative) and include a statement, personally signed by the user, of the wish to opt out. The user's opt-out email must arrive within 30 days after the conclusion of Stage 3, or of the elective mediation associated with Stage 3. Post-Stage-3 Option Two: continuing staged arbitrations 200 at a time with fee-holding and streamlining
If neither party elects Option One's court route, the claim is resolved through continuing, staged individual arbitration proceedings: if more than 200 claims remain, 200 are randomly selected (or selected through a counsel-agreed process) per round and filed for individual arbitration; if fewer than 200 remain, all of them file and proceed. Remaining claims are not filed or deemed filed, and no arbitration fees are assessed, unless and until selected into a staged process. After each set of 200 claims is adjudicated, settled, withdrawn or otherwise resolved, the process repeats on the same parameters. The parties' counsel are encouraged to meet and confer, mediate, and engage with each other and with NAM (including through a Procedural Arbitrator) to streamline adjudication, increase simultaneous throughput, promote efficiencies, conserve resources and resolve remaining claims.

13(10): unenforceable portions of the Arbitration Agreement are severable and replaced with nearest intent-match
